A man in Indiana has filed a class action lawsuit against Microsoft, accusing the company of charging him a subscription fee without his consent. Ryan Graves was charged for two years of Xbox Live against his wishes, thanks to Microsoft’s automatic subscription renewal.
Graves’ account had an old credit card number on it due to his inactivity. When he finally got around to updating his information, Microsoft billed him for both his expired and new subscription, leaving him with two years of service and twice the planned expense. MS won’t refund.
The plaintiff is after Microsoft for “breach of contract, unjust enrichment, conversion, and violation of the Electronic Funds Transfer Act (EFTA), 15 U.S.C. § 1693, et seq., on behalf of himself and similarly situated Xbox LIVE Gold members.”
After I moved to the United States, I had all sorts of trouble with Xbox Live. Microsoft won’t let me switch territories, and kept trying to charge a UK debit card that had long expired (it wouldn’t let me just remove the card or cancel the renewals because of reasons). Due to this, it barred me from activating an Xbox Live card that I’d received to do my job, and it was only because of my job at Destructoid that I ever got it resolved. Microsoft’s handling of this part of Xbox Live is, to be fair, completely atrocious.
