Court stops Bethesda from blocking Interplay Fallout

It seems that the battle over Fallout is over… for now. A U.S. District Court judge has denied Bethesda’s motion for a preliminary injunction against publisher Interplay. The ruling came down this week and was discovered by Duck and Cover, but has been confirmed by more reputable sources as well. The ruling means that Interplay will not only get to continue to sell Fallout 1, 2 and Tactics on its own, but can also continue to make the Fallout MMO that we got a peak at thanks to the case.

If you’ve been following the case you know that this is a pretty big set back for Bethesda, who claimed that Interplay was confusing customers with its packaging of the Fallout trilogy and also was not living up to its end of the bargain when it came to developing the MMO. Neither company has reacted yet to the ruling, but we’re sure to hear something from someone’s lawyers at some point. Most likely this isn’t over, but maybe Bethesda will back off for a bit.
