Stemming from his termination ‘without cause’

Almost two months ago, longtime music composer for Bungie, Marty O’Donnell, was let go by the studio. According to O’Donnell, the termination was without cause. He may have had his hand forced, but O’Donnell’s not going down without a fight.

As reported by VentureBeat, O’Donnell filed a lawsuit against Bungie on May 1, 2014 for payment of unpaid but accrued unused vacation time, paid time off, sabbatical time, and “other benefits.” O’Donnell’s requesting exemplary damages in the amount of twice the withheld monies, along with pre- and post-judgment interest at the Washington statutory rate.

Bungie has already filed an Answer to O’Donnell’s Complaint, meaning that the matter is officially a issue. In the Answer, Bungie provided mostly boilerplate denials to all of the allegations asserted by O’Donnell.

In a separate action, O’Donnell brought claims forth against Bungie and its chief executive for reasons not revealed by this action. That matter is currently being pursued in arbitration. If arbitration is denied, O’Donnell stated his intent to move to amend this Complaint to include those claims.
