Xbox 360 shipments derailed, train dumps 21,600 consoles photo

Microsoft has formally filed against DHL for $2 million worth of damages as a result of damaged Xbox 360s on a DHL train that derailed in Duke, Texas. The wording in the complaint indicates that the Xbox 360s suffered from “impact damage, wetting, pilfering and shortage.” If this situation is any indication of emotion, executives at Microsoft Game Studios must be really steamed.

The reason for the filling had to deal with the way DHL “negligently breached its duties as a common carrier, handler, bailee, warehouseman, agent or in other capabilities." In other words, they were a bit off the rails in terms of owning up to the loss of cargo.

One wonders if the engineer of the train was busy drinking because he was an alcoholic who beats his wife. This is fairly unfortunate for all those involved. Especially for all the people who were set to get these units after the shipment was received in Hong Kong. In the future, Microsoft should probably stick to shipping things by plane. I hear that it’s rare when air cargo gets lost out of the blue.

21,600 Xbox 360s times $200 (the cheapest Xbox 360 on the market today) equals $4,320,000. They're only trying to get $2,000,000. That's only enough to cover the retail value of 10,000 Xbox 360 Arcade SKUs. Why would they only seek retribution for less than half of their losses?

i bet MS staged this. they stocked the train with all the RROD consoles that were sent for repairs. then they derailed the train and are trying to make up for the loss from the RROD by claiming it was DHL's fault.

Was the train carrying a total of 21,600 consoles, or is that the console death toll? Maybe it's a combination of manufacture cost + shipping cost + death toll<21,600.

I can remember the stories about the ship that ran aground, tipping its load onto the south coast of the UK. There were motorbikes and other stuff (maybe games consoles as well), and the amount of people who turned up to take freebies were astounding.

They haven't sold those boxes yet, so there's no point getting damages for sales. If they get back the manufacture cost they can just sell the new ones they make, and wouldn't have lost anything except for time.
