Why threatening to shoot up your school on Xbox Live is a bad idea photo

I've heard my fair share of stupid filth from the mouths of gamers on Xbox Live, but one Frostburg State University student just topped 'em all by getting charged with two misdemeanor counts of disrupting a school operation because of a threat he made on the Internet.

While playing Call of Duty 4 online, Allieu Shaw (thanks for the link, Lawl) talked about "shooting up the school" and also managed to let out "how he was going to do it." Big mistake.

A concerned CoD4 player from Oregon reported Shaw's threat to the Frostburg Police Department which led to Microsoft releasing his IP address and his eventual arrest.

Shaw later admitted that the whole thing was just a joke and how he had "no intention of following through with the threats." While there were no guns or incriminating evidence to be found, it just goes to show you that Xbox Live isn't as anonymous as you might think.

shit, I've done way more stupid things like this plenty of times. Seriously, I thought you could say whatever the fuck you wanted to on Xboxlive? Next thing you know it, you won't be able to say these kinds of things while in your house with the lights down low, in your basement with one hand on the mouse and one in your pants. that's how serious this is going to get.

Not necessarily all at schools, but I seem to recall in the last few years events of random shootings occuring quite a bit.

then nothing would have happened. When you become mad at someone at school and say that "I'm going to fucking kill you", does that mean that you ACTUALLY will? no, of course not. You say dumb things when you're angry. It's human nature. You just can't think straight. Most people that get in a fight tend to regret what they had done to the other person and themselves when they calm themselves down.

Like just last week, some kid became angry at me when i received the highest grade on my Bio AP test in the class. He told me "People like you need to get fucking shot in the head before your kind get out of hand and blow up a fucking building." Do i take shit like that seriously? No way. The next day kid came up to me and apologized say he was sorry and asked me if we were cool. Of course I just said no. Not because i hated him, but because i hated him for his voice. Deep inside, however, i knew that he really meant sorry for what he had said.

MS can and must track that stuff because things like what happened can be considered evidence if something had happened. I'd imagine that anything with an Vision camera probably gets archived somewhere too, so think about that the next time you wanna flash your ween on camera in Uno.

@007: Yeah, but school shootings — regardless of how much we want to marginalize them in our minds — have become disconcertingly common in America. Even your classmate was out of line, and he knew it too; that’s why he apologized to you the next day. There’s a big difference between saying, “I’m going to burn your house down,” on Live after someone kills you, and detailing a school shooting.

I’m glad this punk got arrested. Hopefully, it’ll serve as a warning to future wastes of life who want to pull this shit.

The reason why it was taken seriously unlike other idiot threats from other gamers is that the player described how he was going to do it. It's on thing to say you're going to kill or destroy thsi and that but once you describe it in detail that someone else recognizes the place then people will take it seriously. Now why is it that there's always gamers who think this is not a big deal. I'm guessing if he did shoot up the place and no one on Live who heard the threat reported it they'll say MS or the school shouldve done something. I think sometimes some gamers live in a reality separate from the real world.

So to who is defending this kid should we just turn a blind eye to this stuff? I've heard people threaten others with violence before and normally I take it with a grain of salt, but going into detail on how you would do it means you have thought about it before, premeditated it if you will. I'm sure some of us have thought things like that before but to express it in a public forum of sorts and explain how you would do it should ring alarm bells, at least it would for me.

Did he have every right to say what he did? Yup, free speech says you can, but there are consequences for it as well. If nothing else this kid should get a real good reality check from this.

Yeah ya gotta watch what you say cause its not really MS place to say here is a free place to say whatever you want plan terrorist attacks or whatever. At the end of the day if the Police/FBI/CIA come to MS with a subpoena for information they will provide it. I do understand that there are some things people say they don't mean just dont say anything that requires the opinion of 12 to clear you.

If you make a serious threat like that over a voice chat, no-one can tell if you're being serious or not. There's no nudge-wink over Live in the middle of a COD4 match, he needed to be arrested to stop him if he was serious and to have some sense knocked into him if he wasn't.

Its one thing to say you're going to assassinate the president, that's just a crackpot talking really but shooting up a school is something much more likely and possible to happen. You just can't take the chance.

Yes its human nature to get angry and say things we don't mean. But if you say your going to shot up a school and give details then there is a problem. It clearly means that the kid thought it out. And he says he was kidding, he was caught of course he was going to say its a joke.

Oh and for this kid who said you needed to be shot in the head. Now what if he said he was going to shot you in the head? Said he was going to come to your house, stating the address, gave a range of time and date, told you what window he was going to break into. Seemed to be very familiar with the layout of your house. Knew were you slept. You see those are details and if he said that to you. You'd probably be a little worried. So come off it, I know you probably love hiding behind live for insults, racist remarks, and whatever else, but you gotta know these things can get you in trouble

Alright, to those of you calling upon the power of the freedom of speech: Screw you guys, stop defending him, and more importantly, stop pretending you understand the law. Freedom of speech doesn't cover this jackass.

This falls under the laws concerning the making of a terrorist threat, which following 9/11 has been broadened in many states to include "criminal" threats, not just terrorism.

The most commonly used definition of a terrorist or criminal threat has five elements:

1. Someone willfully threatens to commit a crime that will result in death or great bodily harm. This means that the threat obviously has to be of a highly dangerous nature. Threatening to slash someones tires, for instance, would probably not be sufficient. However, the threat can be made in any medium, written, orally, or electronically transmitted.

2. The threat was made with the specific intent that it be taken as a threat. Although this certainly seems like a redundant sentence, it is meant to convey that the threat is a crime even if there is no actual intent to carry it out. The only intent you need is the intent to make the threat itself. So if you threaten to blow up a school, you will still be guilty of this crime even if you are completely unarmed and have no means of accomplishing this at all.

3. The threat is so unequivocal, unconditional, and specific as to convey a gravity of purpose and immediate prospect of execution. This extremely complicated sounding sentence is very important to the law, so let's break it down. Remember you must satisfy ALL of these requirements.

Unequivocal: This means that the threat must be a direct statement of what you WILL do, as opposed to CAN do (i.e. "I could be the next man to blow up the federal building" does NOT count).

Unconditional: This word is very bizarrely used here, because the courts have directly held that conditional threats ("If you touch me again I'll kill you") DO qualify. It is a gray area, but presumably, the fewer conditions used, the more likely the court will rule that it is a threat.

Specific: The threat cannot be vague ("if you don't give me a million dollars, something bad will happen").

4. The threat actually caused fear in the victim. People must actually believe your threat for you to be arrested for it.

5. The fear was reasonable. If you said that you are going to blow up the White House with your spaceship, it is unlikely that any reasonable person could take this seriously.

All of those apply. This kid is gonna get boned.

And in closing, I would also like to say that school shootings aren't common. Otherwise they wouldn't be news. And the only reason they occur is because teachers and counselors either aren't trained or don't care to pick out potential problem students. With a little care and compassion for these young people, many of these terrible events could have been prevented.

Unfortunately, the article's light on details. What was his "plan?" Was the kid mentally unstable and vicious or just unsurprisingly stupid? Was the lockdown of the school warranted or an overreaction to some kid's big talk on the Internet?

I'm not defending his actions, but I'm not so sure I approve of the huge reaction either.

Why are people treating this as if Microsoft is part of some grand-scheme to spy on people?

The guy made some remarks under his screen name, someone reported his ass by identifying his screen name, the police contacted Microsoft seeking the information belonging to that screen name, and the shit was arrested... Simple... Had no one reported him, I'm sure nothing would have been made of it. It's not like Microsoft records all the stupid vomit that's sprayed over XBL, getting some pleasure in listening to people say "Fuck you, Fag! You're soooooooooo gay, you homo." I'd feel sorry for whoever's job that is.

Another thing that sticks out for me is the fact that this guy was 19, and a University Student, not just some angsty 13 year old. This guy was plenty responsible for his actions.
