About a month ago, The Romantics decided it would be a good idea to try to sue Activision over a too-accurate cover of their 80s hit, "What I Like About You." The song appeared on the "was supposed to be $19.99, Activision turned around and sold it for $49.99" PlayStation 2 "expansion," Guitar Hero Encore: Rocks the 80s.
The facts: The Romantics had given written permission that the song could be used in the game; Activision made a lot of money on the game; The Romantics thought the cover sounded too much like the original, decided to take matters to court; Activision's lawyers probably make more money in a year than The Romantics have made in their entire career.
To the surprise of no one, this past Monday, a federal judge in Detroit denied The Romantics pleas to have the song removed from the game. Federal Judge Edmunds smashed a gavel in shape of a Gibson Explorer, declaring that Activision did exactly what they were supposed to do in terms of securing song copyright.
"Activision is pleased with the ruling and thinks that the case is without merit," the company said in a statement today. "Respect for artists is an important value of the company and Activision has a long history of supporting artists from a range of entertainment fields. The company believes videogames represent a growing opportunity for the music industry to reach new audiences and a strong source of potential license revenue for both bands and music publishers."
