Square Enix shuts down Chrono fan game Crimson Echoes photo

Square Enix dropped a Cease and Desist on a fan made game modification called Chrono Trigger: Crimson Echoes. Almost complete, this was a new story set in the Chrono Trigger universe, tying Trigger and Cross together. Before the party was crashed by Square Enix, the game had over 35 hours of game play, with ten endings.

Crimson Echoes was set to release on May 31st for free, but Square Enix called off all ROM modification activity with this letter (PDF file). In it they say that "ROM altering and modification is illegal," and that "statutory damages for willful copyright infringement are up to $150,000 per work." 

We hereby request and demand that you immediately remove, take down, delete and destroy all work on CT:CE, as well as all other Square-Enix related ROM hacks currently on your sites.

Some of the wrist slapping extends to popular fansite Chrono Compendium for their research on ROM modification and listing of prior modifications.

Damn, tough break guys. Sorry to hear for your loss on years worth of work. Crimson Echoes (trailer below the jump) looked very interesting.

The smartest part about the Cease and Desist is that Square Enix not only loses existing fans, but any new fans who would have been made aware of Chrono through blogs, fansites, and forums creating positive interest in their IP.

Think of all the money they've saved.

The funny thing about resurrection was it wasn't even a full game, it was just gonna be a 7-8 of the major scenes in the game redone in 3D. I think Chrono Resurrection could of went on had they just changes all the names then square couldn't say shit because they then not using any copyrighted material. But this fan project did have every right to be shut down, it's sad yes, but they were using all of squares copyrighted material to make a new game.

This isn't an issue of the legality. Obviously, the company can do anything it wants with its copyrighted material. The thing is, most companies ENCOURAGE their fanbase these days. S-E uses their legal authority to squash a completely independent and self-motivated effort. Legality isn't in question. Stupidity.. well its self-evident. Morality has gone out the window.

Clearly this is a conspiracy to ensure that the shit storyline of Chrono Cross remains cannon for all eternity for fear of the Dark God Zardoz awakening and saying the word that would end all existence and God.

I really don't understand this kind of behaviour. Developers/publishers who do this are fucking stupid. All this achieves is to generate ill feeling from fans and the people who poured thousands of hours into a project and for what? Just because they can. Spiteful dickheads.

Maybe they are afraid that fan made games might impact on the sales of re-re-re-re-releases of their games.

If Square Enix Eidos JUST found out about this project and cease and desisted them, then I wouldn't have a problem. BUT, if they knew about the project for some time now and then dropped the bomb on them when the project was about to become a reality, then it makes Square Enix Eidos look like a dick.

I wish I could feel more sympathy considering the work they put into this; but this sort of fan game always seemed sort of waste to me.

I mean, if you have the time, ability and resources to actually make a game yourself, why just redo someone else's? You could... *GASP*... MAKE YOUR OWN! A little originality can't hurt you... and looking at this, it seems it might even save you from legal action at that.

Just make your own shit and this won't happen, kids. :P

I used to feel vaguely bad if I pirated a Square/Squeenix game, as I've always tried to buy all titles that I feel are worth owning. This includes all FF main series games except 11, Xenogears and of course Chrono Trigger & Cross.

I won't feel bad any longer. In fact, i'm not likely to pay for ANY further Squeenix games after this. Grats on alientating a large portion of your most loyal fans S/E!

I'm expecting this uploaded to somewhere now. I wouldn't be surprised if they just finished the project and uploaded it to some torrent site or shove it in a Rapidshare link and let the masses have at it. In fact, I want this to happen, but I'd rather not see them fined thousands should they be found out.

My family flipped out over this. MY DAMNED PARENTS PLAYED CHRONO TRIGGER. And don't even get me started on my brother. This is the kind of stuff that gets companies death threats. I commend the developers of Crimsom Echoes for reaching the point that they did, and while I wish no consequences upon them, I'm sure many of us here would like to see the project completed despite the C&D. That said, It's still the developers' call; we applaud you nonetheless.

The stupid thing about this is that this IS outside of their legal sphere of influence. This was a homebrew project that was being sold with no commercial benefit and with no risk to Square's properties. It was essentially the video game version of fan fiction.

One of Square's idiotic lawyers took US (or maybe Japanese) copyright law, interpreted it ridiculously loosely and then applied it to a jurisdiction that the law may not even cover. And even if it did - chances are this would fall firmly under "fair use". What we have here is a large corporate entity bullying a few individuals who don't have the means to fight back. With a competent lawyer who's well versed in copyright law and fair use these guys could most definitely send SE packing (and probably force them to pay for their legal fees too).

And that's it. All they did was send a cease and desist letter - a letter which could easily have been ignored. If SE wanted to sue them then they'd have to argue their position - which is a seriously weak one. See kids, this is how corporate bullies criminalize perfectly legal and harmless creativity. They scare people with C&D letters first because they know they'd have to be INCREDIBLY lucky to win most of these cases and they don't want to risk losing and then having their loss cited as a defense in further copyright cases.

Disgusting. These guys should grow some balls, throw the letter away and release the game anyway. Then if SE's lawyers come calling stand up for themselves in court.

Pretty sure this is the same shit that happened with the 3D Chrono Trigger remake some idiots (no insult to their work, it looked fantastic, but they're still morons) were making until they announced some sort of upcoming demo or WIP release and got shut down the same way.

For any retards planning to do something like this in the future, do everyone a favor and just put the damn thing out and don't fuck around announcing a release date like you're fucking legit. PROTIP: They can NEVER shut down your project once it's public on the Internet.

Alas squeenix isnt the only company that would do this, in fact I really can't imagine a company that would let such a project happen. Maybe this is the lawyer in me speaking but Chrono has a special place in our hearts, what if this game sucked ass? It would ruin the game's reputation to potential fans, and trust me guys Squeenix is sure to follow the money and make a sequel lets just hope we're alive to see it.

It's strange how some companies just don't get that fan bases are important. Square has totally lost their way, I haven't bought anything made by them in years.

They were the reason I got a Playstation, now I'm growing more and more bitter towards them... This is just pushing me one step closer to hating them, and I think I'm only a couple steps away.

Take some lessons from Capcom, who are starting to realize fans are important, and are now catering to us. Until you can do that, I bid you adieu Squareenix, you shant be seeing my money till you fix your company.

YES, it's a bummer the game was so close to complete, but to say that SE handled this badly is just insane and childish.

If the team working on this wants to get their work out, they should develop their own characters, locations, etc.. stuff that doesn't infringe on Square's rights, and obviously they'd probably need a new codebase to work off of..

I mean really.. if you're gonna rip off someone else's work, at least keep it on the DL until it's out in the wild.
