Sony: PS3 hacker Geohot has fled the US photo

Sony claims that PS3 hacker George "Geohot" Hotz has fled the United States in an effort to escape his participation in the notorious PS3 jailbreak suit

A document filed by Sony alleges that Hotz is currently residing in South America, using his new location as an excuse for not handing his impounded hard-drives over to the publisher for a thorough scouring. Sony adds that "attempts to dodge this Court’s authority raise very serious questions."

To further demolish Geohot's case, Sony claims that he lied about owning a PlayStation Network card. After tracking the serial number one of Hotz's four PS3s, Sony was able to determine that he'd created the PSN account "blickmaniac."

GeoHot's South American move can be seen as one of two things -- a nervous retreat that's a far cry from his confident rapping persona, or a cocky "F-You" maneuver that will confound his enemies and impress his friends. Whichever side of the fence you're on, let's agree on one thing -- that Geohot should bring me back a toucan.

If it's true then he knew he was going to be made an example of. Grounds for punishment or not. Personally I want to hear more raps, I laughed my ass off at that first one!

You should know by now that Terms of Use and Agreement are meant to counter this. You know, the text you accept when installing anything? Come on dude.

Yeah, because companies should be able to self-legislate with mountains of unskillable text most people don't even read. That's a great reason for people to not be able to use their own devices how they wish (excepting the breaking of actual laws, like piracy).

If he did in fact have a PSN account, then a whole lot of geohot apologists and their "he's not bound by the EULA" arguments just got squashed. This kid is beyond screwed.

I don't know where to side on these situations. I never jail broke anything nor have I ever pirated video games. But I just think its damn funny that sony is raping this fool up the anal hole. Maybe this bold move by sony really is the only way to stop piracy. And ohh noo he didn't pirate only jailbreak, well you can't have piracy without jailbreaking so he was pretty much asking for it I guess.

I don't know man, probably has to do with the ToS.. I mean, we are well aware that we are accepting it even though we don't read it. Therefore Sony has the right to do whatever they want.

I know it sucks but that's ho it works. =/

You can do whatever you want to your Ps3, but I believe the issue where things become troublesome is that you are not allowed to alter the software. I think you would have the same issues with a PC if you bought one and then started messing around with the windows software that game installed on it.

@backstab - it might be "your" hardware but its not your OS that's being cracked. That's the difference. An OS is intellectual property as well.

Anyway, running from the law is the sign of a guilty man. Given how petulant and dickless Geohot has shown himself to be, I guess we shouldn't be surprised.

GeoHot's main position right now is that if Sony don't want to sue him in his place of residence, it sure as hell shouldn't be in California (Where Sony know that it will eat up more of his resources to get down there AND the judge is known for siding with media companies).

What his lawyers are arguing is that the contract for the software is with Sony of Japan which has many references in the ToS and in the SDK agreement. His argument being that it has nothing to do with SCEA so they shouldn't be able to decide where to sue him.

@killias2

It is not self-legislating. They put an agreement in for you to buy their equipment. If you break the agreement they can do nothing to you. BUT the court can.

Also i don't think anyone smart enough to haxzor the code would have any trouble understanding this:

2. RESTRICTIONS

You may not lease, rent, sublicense, publish, modify, adapt, or translate any portion of the System Software. To the fullest extent permitted by law, you may not reverse engineer, decompile, or disassemble any portion of the System Software, or create any derivative works, or otherwise attempt to create System Software source code from its object code.

@bolduk: I agree with backstabbing. Sure there's the EULA, but like he said you "should" be able to fo whatever you want with it.

Geohot sounds like an intelligent person but perhaps lacking in common sense. I understand what he was doing as a matter of principle but he should've been aware of the potential ramifications. Unfortunately for him people took his tinkering to open up the PS3 for pirating. Me? I was hoping this case would end like the iPhone where jailbreaking was the owners prerogative but looks like not.

But if he ends up staying in SA I'm sure he'll do well for himself.

What a complete total douchbag .

Didn't people donate tons of money to his legal fund because all of his money was already spent on his lawyers?

What a thieving asshole and he had the audacity to tell people if they donated it would only go to his legal funds, if this is part of his defense what's next? A trip to Disney land or a trip to austrailia ?
