Rock Band makers slapped with class action lawsuit over drum pedals (Update) photo

Kick, kick, kick... crunch

Oops, did your Rock Band drum pedal break? It's probably not the most suitable piece of plastic when you think about how many times it's going to be stomped on during game play. Was the inclusion of this breakable pedal just crap planning, or was it something more deliberate?

The lawyers for Kansas resident Monte Morgan think that Rock Band's makers were out to "cheat large numbers of consumers out of individually small sums of money” by selling kit with a "design defect," says GameCyte. That's why they've hit Harmonix, MTV, EA and Viacom all with a class action lawsuit. 

From the complaint:

Due to a design defect, the bass drum foot pedal (which is an integral component of the Rock Band drum kit) fractures under ordinary and expected usage, thus rendering the pedal inoperative. Without a functioning bass drum foot pedal, consumers are unable to use the Rock Band drum kit or play the Rock Band game in the manner marketed and advertised by Defendants, thus depriving them of the value and enjoyment of their purchases.

What sucks for them is that they extended the Rock Band warranty for customers up until October 1st of this year. Unfortunately, this extension might end up as proof that Harmonix realized that the pedals were defective. 

What's worse is an image that GameCyte dug up, above. The "improved" drum pedal market points to something being wrong with its predecessor. On top of that, the Plantiffs allege that the warranty expiration was timed to drive existing owners of defective kits to purchase the new game.

The defendants are seeking unspecified damages, and want the court to order an injunction, which could have Rock Band listed as defective and removed from shelves.

I don't think anyone will stand up and say that the pedals don't suck. It remains to be seen whether this was a deliberate scheme or not.

I'll stand up and say the pedals don't suck. I've had mine since last November and it's still alive and kicking (har har har).

It's what the Golden Avatar said. If you play it right, putting the pressure on the end with the soft rubber bumpers, instead of in the middle where there is only thin plastic, then you shouldn't break your pedal.

I won't argue that maybe they should have foreseen that gamers are clumsy oafs who break everything they touch, but this certainly wasn't a grand scheme set out to nickel and dime consumers.

Nickel and diming them by replacing them under warranty until it expires?

I've had my RB drums for almost a year now and haven't had any pedal problems.

Smells like somebody's hoping for a settlement. Combined, these companies have near infinite legal resources, but I doubt they'll even really need them. Not only will such a plot be difficult to prove, but Harmonix is already offering a remedy to those with defective pedals, thereby negating whatever minuscule damages Mr. Morgan is claiming. Expect this claim to be dismissed rather quickly.

Not gonna happen, Kansas. I've also had my Rock Band drum kit since last November and it works perfectly. It's improper use. Idiots "stomp" on it instead of just placing their foot on top and applying pressure when necessary. Even the in-game tips (at loading screens) and tutorials say so.

wow, i didn't realize there was anyone who didn't have the pedal break on them. using my friends scientifically accurate of method of polling 5 people i know that had their pedals break, i can assume that 100% of the pedals sent to florida were in fact defective. on the flip side i do not think it was a bait and switch, or whatever by ea/harmonix, but i'm sure that if they did any real quality testing they knew their shit was shoddy. i personally went through 3 pedals, 2 replaced by them for free, and finally buying one of those heavy duty custom ones off ebay for $20.

also there is no such thing as improper use in this sort of situation. if you make a product that is basically a toy, you must accommodate the lowest common denominator.

I'm with thunderpudd.
My pedal broke and I am certain I am not the only one.
I got my first replaced but within weeks of barely being used, it had cracks. I ended up just buying one of the wooden pedal kits and it has been fine since.
Though I do not think that the shitty pedals were part of an evil scheme by Harmonix or EA, I can't believe anyone here would deny that the thing is faulty.

I've gone through 3 friggin pedals and I was happy the customer service when they replaced them with no questions. The 4th time it broke, it was out of warranty and refused to buy a pedal from them to have break again and got a pure metal one off of eBay for 40 bucks. Never broke and impossible to break. It's the same one from the ION drum kit.

Holy shit, I'm so glad someone did this. I went through six pedals (in two months) before my warranty expired, and I bought the aftermarket "Pedal Metal" to finally solve my problem after I could no longer get free shoddy pedals. The "improved" version of the pedal with a few additional bars of plastic crisscrossing the bottom lasted at best a couple days longer than the original version(s). (There were three in all, and they all sucked).

EA/MTV/HMX had this coming, especially with the warranty extension, which invalidated their claims that the breakage was due to user error. Also consumers now have the option to BUY a RB2 set, but we should have had a working set to begin with!

Best case scenario: free RB drum set for RB1 owners!

If you go through six pedals in two months you are doing it wrong. You'd think after the second break you'd adapt and learn to play the kick properly.

Sorry, double post, but I didn't realize people actually thought the pedal was sufficient. To those saying to use the pedal "correctly"... when I'm five-starring Blackened on expert I'm not thinking about how to prevent my flimsy pedal from snapping in half. I play as I do on my real set, as a real drummer would: stomping the hell out of the bass. That's how it's done. You can't bounce those fast hits with finesse; it takes pressure, and the pedal can't handle this.

We have had our pedal break, but we never bothered to replace it so it just stayed broken. But it broke when a friend of ours who has been drumming for over 30 years came over to play RB with us. He has had 4 (possibly more by now) pedals break on him.

saying it's the users fault is ridiculous. this is a toy, not a real drum set, or even a drum simulator. and as such it was a toy that was built cheaply. it requires one simple action... step on it. if the manufacturer did not have the common sense to build it properly it is not the users fault. just because it's a great game doesn't mean they get forgiveness points on this issue.

I've been playing drums for 8+ years now, and I play the Rock Band kick just like I do on my real set: beating the ever-living shit out of it. But I still maintain proper technique which puts no pressure on the sensitive parts of the pedal

Skip to about 2:30 and check out those double hits. I don't know if you can just move your toes really fast or something, but when I hit those I have to use the bounce (as with a real drum pedal). And in order for it to bounce, you have to hit it reasonably hard. There's no work-around and I can't just "change my playstyle". I am a drummer and this is a drum set! I promise you, I don't just suck at RB drums. I've gold-starred (though not 100%) the song above...

I started writing that post before yours showed up... haha. And yeah I push with my toe, but it moves down from the very tip of the pedal, and I end up snapping it in the middle/top area. I don't think it is bad technique necessarily... if I play right on the tip of the pedal I can push my foot right over the top when the part gets hard.

I don't think the technique argument is necessarily relevant anyway. Tons of RB drummers don't know the first thing about playing set. As long as they follow the directions and don't wear army boots or something, the product shouldn't break, right? I mean there are only a couple of warnings in the manual and I am not disregarding them...

I had a pedal break on me, but it was my cousins... I feel horrible for it even though I was doing nothing wrong. It was on Saints of Los Angeles if anyone cares. Anyway, they are flawed. I am not a huge 250 pound oaf who stomps his Thor-like foot on the thin plastic. I am 5'7" and 140 pounds.

My entire foot was on the pedal, and I had no shoe on. Moreover, it did not break in the middle even, so you can't blame stress on the middle! It broke at the bottom right above the plastic that is on the metal rod. My pedal also has a small crack at the same spot.

Well, the only thing harmonix is guilty of is underestimating how dumb people are. First: put the pressure where it belongs, on the rubber-bumper end of the pedal, not the middle. Second: just press it down quickly and firmly; don't stomp it through the floor.

The two RB kits in my household haven't experienced this issue, and none of the players I know IRL have had any issues. The only real evidence I've seen of any problem is whiners on the internet.

Hm, I wonder if maybe Harmonix heard that the pedals were breaking, so they extended the warranty.
Kind of like Microsoft did in response to the RRoD.

And then, perhaps they made the warranty expire when they were releasing a stronger pedal.

And there may even be a slight chance that they made an "improved" pedal because of all the complaints about the old one.

Nah, not a chance. The lawyers are right. They're just dicks.

I know that my pedal was broken right out of the box; however, EA was pretty good at getting replacement out. In fact they screwed up the order and sent two pedals under the same waybill number. So, when I had to return the defective one I kept the second one -- just in case that one died, too.

Yeah, my original pedal broke a little while back after my warranty had expired, but I sent it in and got a replacement free of charge.
