PSN banning lawsuit thrown out photo

Do you remember Erik Estavillo of San Jose? He was a "man" who had been banned from the PlayStation Network after being an abusive little troll on Resistance's multiplayer mode, and decided to take Sony to court over the "pain and suffering" it had caused him. If you recall that adventure, you'll be thrilled to know that the little turd has had his case thrown out of of court.

Northern District of California District Judge Ronald M Whyte decided that Estavillo, despite claiming that the ban had emotionally crippled him, was not deserving of relief from Sony under the First Amendment. Estavillo was trying to get $55,000 in damages and also sought to get an injunction that would limit Sony's ability to ban players in future.

It's nice to see that not every worthless, pathetic, frivolous lawsuit can go to trial. That said, America should sue Estavillo for wasting everybody's time and taking up oxygen that could be used by more deserving human beings.

omg... fuck yea what a little douche. If Sony has proof of him disrupting gameplay of other players like that, good for him. Sony should even take back the PS3 from him for that stupid stunt.

After the spiraling depression caused by that N+ article, it's nice to read some good news. BURN THE WITCH! BURN THE WITCH!

Man that header confused me for a minute. I thought Sony was trying to ban lawsuits, and it got thrown out of court.

But either way, good on the courts to throw this garbage away.

Wow... I think I'm actually amazed to see the American court system work correctly for a change!

Yet another example of why we need laws the specify if you sue someone and lose (or get the case thrown out), you have to pay the defense legal fees.

He wouldn't have won regardless, he signed a TOS that certifies he was booted for being a douche online.
Thankfully someone actually did some reading when considering if this was to go to court.
For once.

True - your TOS to play requires you to not act like an incorrigible asshat.

Which, of course, he is.

Whatta little bitch.
