People are always complaining when companies want to try and PREVENT piracy of their games/systems through updates even though it will eventually be hacked again, but it DOES deter a lot of piracy.
It's RIDICULOUSLY easy to pirate DS stuff and the Wii isn't much better. Maybe if Nintendo put ANY effort towards it at all then third parties wouldn't have such a hard time selling anything on the Wii.
Nintendo has always come across to me as the most arrogant of the big three console makers. They honestly seem completely out of touch with what the core gaming demographic really wants and CONSTANTLY go as far as saying it point blank pretty often.
So long as they're making money, they don't give two shits about the OCEANS of crap that gets put on their system or about the crap that piles up on good developers trying to make good games and a little bit of money to get by.

The games are unbuyable (I've never seen a touhou game posted on ebay or Amazon) and yet it's the proof of the success of user-generated content. I listened remixes from the series for months, have seen hundreds if not thousands of examples of impressive fan-made artwork, dozens of fan-made games, hundreds of fan-made mangas, mousepads, plushes, costumes, even cds of the music. But trying to get an "Embodiment of Scarlet Devil" cd, or any other of the 12+ games in the series, is among the most annoying thing I have ever attempted.
I don't mind hacking, but copy/stealing games is some of the scummiest behaviour there is.
When it's just come out though, it's just a dick move that hurts the industry from making quality titles. Developers shy away from the platform in delivering anything substantial since, well, they're just going to lose money on it anyway!
So yes, enjoy losing good games for more shovel ware, kids. This behavior actually ENCOURAGES that; low-no effort games. Same thing happened to the PSP until the homebrew scene was effectively locked down by Sony and lack of developments.
Just by the game not being available there's now more incentive to pirate then there would have been had it been available in those territories.
First, when DRM makes games unplayable, then piracy becomes a necesity.
But more than that, why on earth would Nintendo want to appeal to people that if given the ability, would steal/refuse to pay for everything they make? Is that really the type of person any buisness would want to do buisness with? Mind you, I'm not talking about people who would take free stuff if they could do it without reprimand even, but people who void their warranties, buy specialized equipment, and/or research methods of getting content for free.
Also, I disagree on Nintendo being the most arrogant. I think Sony is the most arrogant this generation, they are out of touch with what the masses want, only able to appeal to the super-core gamers that are stupid enough to buy a PSPgo. They were really out of touch when they were selling Playstation 3's for $600's on their ability to play blue ray disks and run linux. I would say the Nintendo had to humble itself tremendously to admit that they couldn't compete with the PS3 and Xbox 360 graphically, while Sony arrogantly ran it's console buisness into three straigh years of poor sales, bad assumptions about consumers, and billions of dollars in losses in it's gaming department.

Basically, if you live in the retail zones where this game isn't available and you choose to pirate the game I'm not going to be pissed at you. However if you can buy the game easily, but choose to pirate it, you're not getting any sympathy from me.
There was never any incentive to sell the games in those territories because of piracy, so piracy can't hurt a net income of zero off the game. The company had to admit that the game had no value in that region because of piracy, thus effectively making the value of that game in that region zero.
I suspect that the strongest force motivating piracy in many regions is price, and the easiest way to lower pircay is to lower the tariff. Brazillians and Australians should not have to pay double what I pay for a game. I'm not sure about Australia, but in Brazil I know the motivating factor is rediculously high import taxes. I am surprised that there does not appear to be any inherent push towards more free trade in those regions though.
Incidently, China has similar problems with piracy. Over there, it's institutionalized. Most software vendors can tell a pirate from a non-pirate fairly easily when issuing updates (aparently), and in that country the issue is so bad I'd bet that Microsoft could cripple their military with a single update. anyone remember the incident where pirated Microsoft Operating Systems were updated with a background asking the users to buy legal Microsoft Software?
but you seriously cant' expect people to buy ALL these fucking games. Like, who is going to spend what could possibly be their ONLY luxury funds for the month on a obscure game over a big game they were looking forward too. I mean some of the stuff that comes out on these consoles are trash. I know, there's the capacity, if you look at AAA titles like MW2 and those, but these little amazing DS and Wii titles? Most of the kids who are into Ace Attorney are kids in their teens who are just starting to work and just do not have the funds to buy these. When I was growing up my parents threw me on my butt in terms of luxuries when I hit the teens. I missed out on so many amazing games, and its the same with many of these kids. For all the adults or early 20somethings making enough, fuck them to hell. But you have to understand why someone is doing something before you can stop it.
But I'm 100% against the R4, and making a device like that just destroys my arguement. If you spend money to pirate stuff, and they aren't too cheap either, that means you could buy a couple of these games. Sure, not as many, but if you saved up, you could have a few.
Go ahead and bash my head in for just remixing the dead "they weren't going to buy it anyway" shit, and I know that the excuses just open the floodgates for more unexcused piracy. I just think its an extremely interesting situation.

I'm gonna have to disagree with you there. Most shipping rates to places like Brasil range from 50 to 70 USD dollars, more than the game itself costs. You put taxes into the mix, and a 50 dollar game now costs 200 dollars.
Incidentally, if you can tell me of any good stores that ship games to Brasil for a reasonable price, I will love you forever.

Great avatar. I would kill for a real localization of those games. I've actually been wondering why the guy never hires a translator and tries to send it west. Those games of his are highly desirable, and I have a feeling that his (admittedly small but very vocal) American fanbase would pay a ton for his games over here if they could.

True, although I am against game piracy in all of its forms. But if you can't find a copy of the uncut DVD version of Batman Beyond: Return of the Joker in stores or on the web, I won't fault you if you want to watch it through less "legal" means. I suppose that makes me a hypocrite, but I never claimed otherwise.
There is no official distribution for games over here (at least until a few months ago), so they're all imported, which mean goverment taxes (very high), plus the fact that there are no stardard pricing, it may change from game to game and the retailer can charge as much as they like for a game.
With this, you get an average Wii or DS game for 80~85 bucks, it's even worse in the PS3 case, you'll find PS3 games like Uncharted 2 or Assassins Creed 2 for 130~140 bucks, and it might get worst when God of War 3 comes out.
Now, someone please answer me, how the hell am I supposed to play video games in here without piracy?
Pirating/downloading games when they're new or even leaked before release without the intension of ever buying them is a crime in every sense of the word. And this is a game in a series that deserves as much exposure as possible.

That is EXACTLY why I have no problem with a certain type of piracy - of course if the game is later released in those areas I would hope anybody that pirated the game previously would go out and buy it, I know I would.
Then there's 'abandonware', games that are just not in print any more and are extremely difficult to get a hold of. While still illegal to download in my mind the same rule of thumb applies. I personally have pirated a copy of System Shock 2. Do I feel guilty about this? No. Why? Because the second it goes back into print and I can legally buy it somewhere, I will.
(It's worth noting that aside from Mother 3, of which I'm in the process of trying to get a legal copy, SS2 is the only game I've ever pirated.)
I guess what I'm saying is this: I'm OK with piracy if it's a means of playing a game you otherwise couldn't. If, however, that game suddenly becomes available to you, you owe it to the developer and publisher to buy it.

That's the issue that we as a gaming community face with piracy. Because, it is due to the ability of individuals in stealing games. Why steal a game from a store anymore? It's because the internet believes in free exchange in information. How as a gaming community do we answer what is right or wrong?
Is it OK for an individual to make a backup copy of their game?
I have been a victim of this issue. I keep a game even thought it has been broken and shattered by my nephew who got into my basement. Due to the powers beyond my control, some of my prized items were broken. I always kept out to show my friends. My cases and cds of Suikoden II, Xenogears, and Tales of Destiny were destroyed. In addition, I forgot to say... they were factory sealed unopened copies of all three games. His mother/my sister wasn't watching him and he gained access.
Using that as a bases, would a community agree or disagree in an individual being able to download a copy of the game online? If an individual would buy a game and not wish to "unwrap it" but still be able to play it by downloading it online. Is that ok as well?

In regards to your high tariff argument, makes sense. It's completely, 100% horse shit but it makes sense. The US has, by far, one of the cheapest regions to buy video games (yet people STILL complain). We are NOT being charged $60 for when Dragon Quest IX eventually comes out here nor are we expected to pay $98 for Final Fantasy XIII. Our region, the US, is by far one of the greatest sales regions. One can amass a huge legitimate collection especially when bin diving. Now keep this in mind as I go forward...
Vast majority of PSPs piracy comes from the states. All over Craigslist are people willing to hack your 360/PSP/Wii or sell you an R4. Some go so brazen as to sell their old consoles with stacks of DVDR games as an incentive to purchase. In our region, there is no excuse for this behavior, and yet it happens. Cheapest damn gaming region IN THE WORLD and people still steal shit.
In my mind that's absolutely fine. In fact I wouldn't even consider that piracy in any sense of the word as you're not stealing the game. You've paid for it - it's like ROMs as long as you have an original copy, and can prove it, it's fine as far as I'm concerned.
Truth be told, it is very difficult to find someone that isn't a hypocrit on the issue. Even ordinary youtubers technically pirate music, television, and movies. I simply find the hypocracy humerous.
Back before the internet you simply did not have these issues. It wasn't possible to pirate so you simply couldn't get access to rare movies, nor were you aware that they existed. Now that there is an easy avenue juxtaposed to a nearly impossible route, piracy occurs.
Come to think of it, Nintendo does a lot of stuff specifically to make piracy impossible and/or undesirable that the other companies don't. You don't pirate metroid prime trilogy or the new mario game because half the value is in the collectable box that you display on your self. Can't pirate wii fit because it requires a balance board. Can't pirate sport's resort because it needs a motion plus hardware. And motion games are very difficult to pirate onto a PC due to the lack of acceptible inputs. I think spoofing up the aspects of games that can't be pirated protects them from piracy. Still, it makes you wonder why any company would want to head towards digital distribution; then there is no inherent difference in the game between the owner's version and pirate's, and in some cases pirates have the advantage.
