I always wanted to play the Mario Tennis on the N64, never had a chance to do it, maybe it's time.
And it sure would be sweet to have the N64 Rare games on VC, really need to play Conker and the Banjo games again..

In the void? You'll never see it. Nintendo's lawyers have but the breaks on this, at least largely in part because of the game's music, which contains pretty clear references to Beatles, David Bowie, Monty Python, even the damned Star Spangled Banner.
It's not safe for them to release it, and they don't seem to want to go compromise it by going into the original and removing the offending pieces.

Well can't they just release it for 0 wii points? if they are not profiting off it they can't get sued right? and then release mother 3 for wiiware to earn money off the series.

Possibly, but then they'd have to pay the bandwidth and server space, so it would be a losing proposition in terms of money, and Nintendo is not in the business of losing money.

All you Wii owners out there oughtta be gettin' Mario Tennis. It was better without the Wacky Antics™ the Gamecube and GBA sequel(s) brought to the table.
