New Zealand judge justifies a criminal's 'GTA is to blame' excuse photo

If there is one thing that disgusts me above all else about people who blame the actions of criminals on videogames, it's the fact that they provide a twisted sense of justification for the scumbags who rob, rape and murder. Making them feel like it's not their fault, that they can just blame a videogame, is a dangerous and irresponsible practice that the anti-games lobby enables, and the lawyers of criminals are pretty wise to it.

In New Zealand, a defense lawyer has argued that Grand Theft Auto made Tim Reid beat a police officer and steal his car. Somewhat successfully, too, as the judge actually agreed:

[Reid] committed violent offences and compulsively played Grand Theft Auto. Mr Nicholls said a video game that showed violence toward police was a public safety concern, with the game promoting the behaviour...

Wellington District Court judge Denys Barry jailed Reid for five years... He said Reid was hardwired for violence and anti-social behaviour and programmed by his recreational pursuits.

Is this really what we want from society? Criminals being made to feel like they're not responsible for their actions? I believe that allowing a person like Reid the freedom to feel like he wasn't completely to blame is far more dangerous than any videogame. This, however, is what certain people want -- it's never enough to let a criminal take responsibility in this day and age, it always has to be someone else's fault. Those who perpetuate the justification of criminal behavior in this way should be ashamed of themselves.

What the hell their judges can do that? Here you need an expert witness and the judge rarely comments beyond his his own expertise.

What absolute tragedy on behalf of the moral standards that the world should be upheld to. I'm not even speaking about games, you could replace GTA with The Catcher in the Rye and I would still feel the exact same way. When we begin to justify actions of people who commit transgressions of the law , the line between right and wrong become evermore indistinct and a total reevaluation of what we are justified and what is accepted, is going to be necessary if we are to allow our actions to be determined and ruled on based on ones relation with the byproducts of society , instead of basing it on our responsibilities and understanding of what is required of us as a part of humanity.

I think the whole "Oh, it's not your fault you killed that guy. It's societies" trend is a back lash to what is perceived as a previously heartless system if that makes any sense. Basically the way I see it a few people with mental disorders got screwed by the system real hard. People wanted to help keep things like this from happening, but took it to far. I think a lot of the people defending these kids may have had their heart in the right place originally, but now they are just out to make a scene and a quick buck. I'm sorry to blather on like this.

I'm not so surprised to the fact that the lawyer has tried to use it as a defence, what really scares me is that a judge justified it... basicly all you have to do when you commit a crime now is saying it was caused by playing to many games...

There's something I'm genuinely tired of hearing, and it's that the game "promotes" the killing of cops.

Anyone who has ever played a GTA knows this to be the opposite, and from the point of San Andreas and onward, engaging in such activities will get you torn the hell up.

At exactly what point during his six star rating, while being run over by a tank as a missile lands on him during an incoming hail of gunfire, did he think it would be a good idea to engage in this kind of practice in real life?

That's the question I would ask as a judge.

The judge may have said it, but it looks like it had no effect on the sentencing, he broke the law, and unfortunately, 5 years is a long time to go to prison in this country if you didn't rape/kill someone.

I think it was probably Reid's heavy use of methamphetamine and underlying psychological disturbance that made him easy to program. Did the judge comment on this??

Also, @Voloman, you don't get a jury every time you go to court, you can request one, but judge's do a lot of the judging themselves. This is essentially a thievery and assault charge, albeit against a police officer.

I'll say that its not what most rational people want. Its what a large percentage of the practitioners in the legal profession wants. Unfortunately most rational people are simply too lazy, too ignorant or too blind to push for tort reform both in the US and other countries.

We're handing more and more power to the parasites of this profession on a daily basis.
