He also willingly chooses to go out searching for treasure knowing that he'll run into resistance. So while he may not shoot first, he knows that he's going to, rather than simply avoiding the matter entirely.
He also robs a museum, attacking innocent guards in the process (Including pulling one off a rooftop knowing that the guard could die), deliberately chooses to double-cross the people who would pay him for his work on two separate occasions, and he does all this not for country or some noble task (At least not until he's already knee-deep in the conflict) but for riches. And up until this point he's never received long-term consequences for his actions or his cavalier attitude. So you can understand why some people would see him as a psychopath.
Unfortunately for Sony Microsoft will be countering this with a full spread of Marcus Fenix in next months Playgirl Magazine.

Well, jimmyx, as you must be aware, all corporations want to have profit: in the end, that's their ultimate goal, so adding a $ instead of S does not add anything. It only affirms the capitalist nature of the company, which reaffirms the capitalist world we live in. One which your country strongly fought for (I assume you're American - I believe I've seen you saying so over here, please correct me if I'm wrong).
If you don't like this situation then maybe that means you're a communist. Which is perfectly fine, I can respect that, even though that's not exactly what I believe in.
