MumboJumbo sues PopCap for $4.6 million photo

PopCap was big pimpin' for a long time, but now they're uh...medium pimpin' after a Dallas judge awarded another casual games publisher, MumboJumbo, $4.6 million of PopCap's dough.

What went down? Back in 2006, PopCap had a contract with MJ. The company would distribute some of PopCap's games in North America. The problem arose when PopCap began distributing the games on their own.

MumboJumbo says that “PopCap committed fraud and tortuous interference when it severely damaged the business relationship between MumboJumbo and a key retailer,” and that some internal emails show that PopCap “employed a calculated use of false and misleading statements in order to sour that business relationship.” 

Yikes.

PopCap responds in a statement: “PopCap continues to believe that it did nothing wrong in this case, and will vigorously pursue its claims and defend itself through the appeals process.”

Either that or the keyboard's breaking...

Still, that court case would do nothing to PopCap since they are always making better games, which makes more revenue and profit.

Don't they have like a hundred billion dollars by now? The kids of PopCap employees probably steal this much every few weeks and no one notices. :P

Basically what happened, for those out of the loop, is Mumbo Jumbo signed a distribution deal for certain games and channels, essentially licensing Popcap games for release. Mumbo Jumbo actually has a larger distro net than Pop Cap on the casual games market. Under the agreement, Pop Cap wouldn't distribute their own games in the same channels and for their troubles, get paid. Well, Pop Cap, through various emails used in the court case, had deception in their hearts (they WERE a pretty fucking evil company before Peggle, folks) and distributed their own versions of the licensed games in the same channels Mumbo Jumbo was distroing through and also undercutting their business partner. In other words, PopCap accepted money to not do something they did anyway. Courts found in Mumbo Jumbos favor.

PopCap, naturally, has begun appeals. It is interesting, however, to see the old face of PopCap return...

Next time PopCap, inform the people you did deals with of any changes in plan.

@Batthink - you don't just "change your plan" in big business you know. You can't suddenly decide to go against the contract, but hey, let them know what you're doing and it'll be fine.
