MTV Games/Harmonix calls drum pedal lawsuit 'opportunistic and baseless' photo

On Friday we reported that MTV Games and Harmonix were being hit with a class action lawsuit over what was being labeled a "design defect" in the bass pedal for Rock Band drums. 

Today, MTV Games and Harmonix have taken the time to respond, calling the litigation "opportunistic and baseless."

"Harmonix and MTV Games are dedicated to consumers having an outstanding experience with our products," a spokeperson for Harmonix/MTV Games said. "When used as directed, our drum pedals are designed to provide years of enjoyment. In addition, at the launch of Rock Band we offered consumers an extended opportunity return defective or broken hardware for any reason whatsoever -- no questions asked."

From personal experience, I've had one pedal break on me while using it "as directed," but this was after close to a year of trying to beat "Run to the Hills" on Expert. Just as the spokesperson said, my pedal was replaced with no questions asked; I actually received a new pedal within less than a week. 

How many readers have had pedal issues? Do you think this class action is necessary?

Never broke on me, and I used it quite a lot. My Rock Band 2 pedal's in perfect condition, however the pads sometimes stop working.

It happened twice during a run of Panic Attack on expert. I still beat it, but the score wasn't as high as it could have been and it was more than mildly annoying.

my original RB1 pedal started breaking after about 6 months of use. i got a 3rd party product off of ebay to affix a metal plate to the pedal and am still using it now (even when i got the RB2 set with an already-metal pedal, i like the feel of my ghetto pedal).

don't think class action is necessary. so far they've dealt with hardware replacements very quickly and fairly, imho. my rb1 guitar broke after, like, a day, and i got my new guitar with no hassle. even after it broke the second time. :P

this is a <pun>bass-less</pun> lawsuit.

My pedal already broke once and I have a replacement. I would like a Rock Band 2 pedal since it is metal reinforced, but I don't want to buy the new drums.

I dont have Rockband but yeah they are supposed to have a metal plate... do they come with the metal plate? That would be pretty difficult to break.

Yeah, I've certainly had my share of issues with it, but I never thought it was MTV trying to take my money. I just figured they'd rushed a shitty product to market without the proper testing. Definitely doesn't warrant the suit.

I've had two break on me and even though they replace it quick enough I just spent the dough and bought the Omega Pedal. The Omega Pedal feels more natural and it hasn't failed me yet.

Mine was dead out of the box, but I had a replacement within a few days, and it's still working.

Baseless lawsuit.

Maybe the lawsuit should be over the compatibility issues of the guitar hero drum kit with rock band 1/2 on the PS3... where's the fix?!

Just in response to their claim that under regular use, the drums work fine. I own a set of Rock Band 1 drums and so far my pedal has broken 3 times, replaced twice. I am really strict on how the pedal gets used, because after the first time it broke, I didn't want it to happen again. After it broke the third time, my warranty was up so I had to borrow my neighbor's foot pedal. This pedal then broke in half, with no warranty, we fixed it with some electrical tape and butter knives. This held up until it cracked again, this time at the base of the foot pedal. These things are poorly designed and can't stand up to "years of use".

And they should be held accountable. Just because they rushed doesn't give them a free pass to put out crap products with no accountability.

Mine broke after about 6 months or so. Just snapped right in half. Cheap piece of shit! The lawsuit is more warranted than the Hot Coffee mod one a few years back, and that was settled out of court.

Mine broke after only about two months. The replacement took forever. I repaired the first pedal with aluminum and duct tape and when i finally got the replacement I attached the enhancements immediately and haven't had a problem since.

I don't think the equipment should break under normal wear and tear, and yes that means making it through an expert marathon session. I don't have much personal rock band experience but if history has taught me anything its this: look at your old peripherals, your zappers, your eagle-eyes, your arcade pads. if these were designed cheaply they wouldn't still be in our collection. I think the ultimate goal of a game should be that in 10 years, will someone still want to play your game? If the answer is no, than your game is nothing more than shovelware.

My rb1 drum kit broke within 2 months also. I had to drill a metal plate i found on to it cause im to lazy to send off for a new one. my rb2 drum kit is being held together by 2 wrong sized screws. it broke in about a month. thanks harmonix for giving us crap to play with.

I don't understand the "but" part of that comment. If controllers, or even Game discs broke after 1 year everyone would agree that's a problem, right? I'd be pissed if my pedal broke after just 1 year. Then again, people seem to think that 2 years is a good run for an Xbox 360, so I guess we're all just used to being sold garbage these days

Yeah i broke one after about two months of 'normal use'. It's not a matter of if, it's a matter of when it will break. I did send it back and got a new one, no questions asked. Then i got one of those screw on metal plates online for about 15 bucks and it feels rock solid now.

It is a bad product, but i can't seem to generate any resentment towards Harmonix. At least they fixed it in Rockband 2. The lawsuit seems completely frivolous. They offer to replace it for free! How has this ruined your life to the point that you need to sue them. Grow up people.
