Mr. Modchips gets shut down, convicted photo

The second big UK mod bust finds Neil Stanley Higgs out of a really good gig. The modchip vending business (www.mrmodchips.com and www.mrmodchips.co.uk) he began in 2002 made him over £1 million, but that all came to an end when the Bristol City Council’s Trading Standards after Entertainment and Leisure Software Publishers Association (ELSPA) tracked him down.

Poor Higgs was hit with 26 offenses, including several counts for possession of multiple chipped consoles, advertising mod chips, and of course supplying and selling them. The consoles found in his home were used against him in court. He tried to argue that some were owned by family and friends, but he was quickly shut down by the Judge.  

“It sends a clear message to anyone tempted to become involved in "chipping" consoles that this is a criminal offence and will be dealt in the strongest possible way, aid Michael Rawlinson, managing director of ELSPA. "The modification of consoles is an activity that ELSPA’s anti-piracy team is prioritizing – it is encouraging to see the UK courts do the same.”

Oh dang, does that mean the feds are coming after me cuz I have a modchipped Xbox? Besides, how is modding a box illegal? Its your game system, you should be able to do whatever the fuck you want with it

I still don't understand how chipping is illegal in of itself.

You bought the hardware. You should be able to modify it how you please. If that means putting a chip in that allows you to play imports or burned games that's the customers decision.

If, on the other hand, he is putting ROMs or games on the drives or memory of the consoles then yes he is in the wrong. But, just chipping or selling chips should in no way be illegal. They have no proof that every chip is going to be used for piracy.

bhive pretty much summed it up.

Problem in the US is that the DMCA lazily makes anything that breaks "effective" anti piracy controls illegal.

Problem in the UK is that they are even bigger bitches than the US when it comes to tech/entertainment industry regulation.

It's assumed that someone who mods a console or is in possession of a modded console is using it to play pirated software. This is the rationale behind all of the legal B.S.

Nice assumptions there... It's the same issue with Bittorrent. If our internet providers opened up the upload bandwidth and companies used bittorrent we could get stuff way faster and cheaper from everyone instead of someone like Akamai. It could save Apple millions for the iTunes Store. Maybe they could pass that on to us? Probably not, but I can dream can't I? Or is that illegal too?

I fail to see how modding a console is a crime. the real issue is the draconian DRM and International rights laws implemented by companies to try to maximize their profits. newsflash, if you let more customers easily buy your products regardless of where they live, they will buy more products and give you more of their money. /end rant

I'm not quite sure that modding the system is illegal. I think it just breaks the warranty. But selling modded consoles is definitely illegal. You are giving people the ability to play games that are burned, not just imports. This could potentially lead to lots of fucking money not being made for the Big 3, and of course the developers and Publishers. Still, this is lame. Poor Guy. You shouldn't be thrown in jail for it. Maybe a slap on the wrist, or just a hefty fine. Jail for this is outrageous. You only go to jail for a few hours for driving with a suspended license here in NJ, and judging by my fellow drivers, this is potentially much more harmful than modding consoles. I mean, you're not hurting anyone physically, right?

I live in south america, so to get a ds title costs like 100 usd.
So i get myself a nice m3 ds simply with a micro sd memory that cost me 60 dollars.

If they want me to buy original games, then i want the games to be the same price as in the USA.

Even if modchips are illegal (which they aren't), modchips that allow you to play imports are not illegal, no matter how much Nintendo likes to claim otherwise.
