I bought a non-used copy of Band Hero for PS2 at Gamestop for about two bucks a few months ago. I don't know why and I still haven't played it. Maybe I was drunk.

Yeah, I'm with Activision on this one, it's a really dumb lawsuit. So your likeness can be used to play other songs. The fuck is the big deal? Pockets not lined with enough money? Lawyers are bored and just want a case to work on?

Eh.. I still think someone didn't understand what someone was saying when the contract was signed and is blowing it out of proportions.
Either way, if the band was paid already for their songs and likeness I don't see why this is getting pursued unless Activision just didn't pay them. I can't imagine, even within all that legal jargon, that its THAT hard to point to a paragraph and say "see, your likeness was going to be used" ..Fucking legalese.
I also don't really find the fact that the complaint keeps getting heard and pushed through to be all that much of a win for any one as much as its 2 high profile sets of people duking it out over nuts and bolts while feeding the justice system with court fees.

Look guys, if your face and likeness were being used by 14 year olds to sing renditions of various Taylor Swift songs, you'd be upset too.
But seriously, this is slightly silly. I'm actually a fan of the Guitar Hero games, I own all of 'em, and all the fuss about the celebrities being upset with their use in the game is just dumb. Oh no, Kurt Cobain can be used to sing a Public Enemy song? Let's go sue somebody! It's all in good fun. Tell me that previous example I just used doesn't sound hilarious in your head.
And on another note, think about all the other guests from the series: Ozzy, Matt Bellamy from Muse, Travis Barker from Blink-182, Santana, Johnny Cash, Adam Levine from Maroon 5, Taylor Swift, and some other ones that are escaping me right now...why aren't they complaining? Why isn't Ozzy suing for people being able to use him to sing a No Doubt song? Or Johnny Cash's estate suing for people being able to have him play drums in a Children of Bodom song? Oh, right, BECAUSE IT'S SILLY AND NOT WORTH THE HASSLE.
