David and Goliath. He-Man and Skeletor. Jack Thompson and Take Two. These famous rivalries have entertained us, thrilled us, and, in the case of the last one, infuriated us to no end.

The infuriating thing about Jack Thompson's constant lawsuits toward Take Two (producers of Grand Theft Auto and Bully) was that, for all his misplaced rage and failed attempts to block distribution of harmless entertainment, Take Two never fought back. Take Two defended themselves, and remained dignified -- as dignified as a company can be, when that company manufactures entertainment where one can pay a hooker for sex and then run her over with a scooter.

But this time, things are different. This time, Jack Thompson is in the other box in The People's Court. This time, Jack Thompson is the one getting sued.

Yes, after Jack's failed attempts to restrict distribution of Bully and his promise to follow suit when Take Two releases Manhunt 2 and GTA IV later in the year, Take Two has decided to file a federal court case against Mr. Thompson. They claim that Thompson has flagrantly abused Florida's "nuisance" law in his single-minded crusade to ban violent video games. Take Two's official complaint states that Thompson's penchant for bringing up threats and lawsuits before retracting and dismissing is irritating: that his lawsuits come at "unpredictable times and under unpredictable circumstances," in addition to harming retailers who do business with Take Two. 

Take Two also complains that Thompson's lawsuits represent an infringement of their first amendment rights, which may or may not be the very first thing every gamer in the world thought the moment we first heard about Thompson's war on gaming. Well, maybe the second thing we thought. The first thing was likely something along the lines of, "What a doucheface."

This is awesome, in so many indescribable ways. Destructoid's first birthday, Niero's 29th, and the filing of a lawsuit against Jack Thompson happened within three days of one another? Without a doubt, this has been one of the best single weekends in video game history.

UPDATE:

Mxyzptlk was kind enough to provide a link to Jack's insanely religious response to the lawsuit. It's worth reading in full, but suffice it to say that he quotes Psalm 35 (which he describes as brilliant, "since God Himself wrote it") and ends his letter by saying "Praise be to God Almighty." 

I'll be the first to say that Jack Thompson seems like a somewhat reasonable guy in person, but he sure knows how to be creepy as fuck in print.

Wait. If he's admitting that God is the one who created video games, then why does he still fight against them? Or at the very least, shouldn't he be suing God? What a douche.

I thought ultra-christians believed that everything God made was perfect. So if JT thinks God made videogames, then he should really be suing Christianity, and therefore himself. Damn I should so be a lawyer.

Well, I doubt anyone will agree with me, but here goes- I don't think Thompson's ideals are QUITE as bad as most people think. Didn't he have his son(like 10 or 11) go in and rent GTAIII(an M-rated game)? I actually agree with the point that there are some games the kids shouldn't play, I think he just went at his lawsuits the wrong way(attacking games instead of the Wal-Marts/Targets that let the kids get M-rated games. I still think he is a big douche, but one of the points that he normally makes(while often surrounded by shit) is a decent one - that young children shouldn't be able to get M games. On a side not(and almost contradictory to my original point), I think someone that is 15(or so) should be able to get M-rated games, and that 18 is too high for M-games or R-movies.

TheRob91: I don't think many people are disputing the fact that young children should not have access to these games and in this respect Jack Thompson is correct. That being said if I ever have kiddies I will be the one deciding when they can view 'adult orientated' material, not some rating sysytem.

The problem with Jack Thompson is his methods, everything he does seems like a big publicity stunt, like you say he should be attacking the retailers that (illegally? Is it illegal in the US to sell to underagers like it is in the UK?) sell the games to children, or perhaps campaigning for greater parental awareness and better understanding of the games that their children play. To be honest I don't think Jack Thompson gives a fucking shit about 'the children' if he did he would have chosen a more constructive way to go about his business. His constant harassment of Take Two is nothing but attention whoring, his arguments have been used before and have failed before with other forms of media and entertainment. They will fail again and Thompson in all likelihood knows this to be case, doesn't matter though because at the end of the day Thompson is getting exactly what he wants.

Yes, its true that the parent should choose, but what he is saying is that, essentially they cant. Unlike movies, M games are often sold to children, and so if his kid manages to get 20 bucks he can just walk to the store on the way home from school or something and get the M-rated game that you don't want him playing. So basically, unless your child NEVER plays games unless you are watching them, because stores are so slack in their policies you cant control what they get. I agree that he goes about it incorrectly, but I just want to point out that there is an actual problem behind all his attention whoring.

I don't disagree that there is an actual problem with underagers buying 'M' rated games but what I am saying is the problem will not be resolved by Jack Thompson going after Take Two. Jack Thompson knows this -as much as he is an ass he is not a stupid man- but he continues his pursuit for selfish reasons.

If you really want the problem of underagers buying videogames resolved you need a legally enforceable, clearly understandable and properly labelled ratings system.(And don't worry I'm not so naive as to think this would eliminate the problem) If Jack Thompson had an altruistic bone in his wretched little body this is what he would be campaigning for, not 'book burning'.
