Interplay vs. Bethesda stuff is going to take a while photo

Thank goodness for the American court system. If there's an issue it will take care of it no matter how long it takes. Or maybe it's the other way around and they'll make an issue take longer than it ever should because of the loopholes and scheduling that occur within the system. I don't actually know, I'm not a lawyer, but I do know that it doesn't look like the Interplay vs. Bethesda lawsuit won't be ending any time soon.

While a judge has already ruled that Bethesda's perliminary injuction to stop Interplay from selling the Fallout franchise was not legal, the battle still rages on for who will eventually own all the rights to the Fallout MMO and if Interplay has actually broken its contract with Bethesda concerning the game. Now that fight has a schedule, or to be more apt, the precursor to the fight has a schedule. According to the filing schedule that Duck and Cover uncovered it appears that a court case won't actually be taking place until 2011 as the draft pretrial order (whatever that is) isn't even due until Dec. 30 of this year. Drafts of pretrials! That doesn't sound anywhere near a resolution.

As the poster at Duck and Cover commented this could give Bethesda a chance to really just wait until Interplay goes dry. Then again, maybe they could really rush this through and we'll have a resolution sooner than we thought. The schedule is after the jump.

  • File draft pretrial order to be filed by: December 30, 2010

"Interplay vs Bethesda" sounds like a great fighting game. My team of Earthworm Jim and Hircine would be unstoppable.

Ugh. Bethesda, in my opinion (of course), royally screws up Fallout, and then when Interplay tries to sell the good ones, they get all pissy. How irritating. In fact, I really wanna play those again, but my computer is too stupid for Steam. Get those up on PSN/XBLA, Interplay! You apparently have until 2011.....

i think interplay should just stfu and let bethesda develop the fallout games. Even the fans of the old fallout games neet to shut their damn mouths,all they do is talk BS.
Fallout3 which is developed by bethesda would prolly be 100 times better than the fallout3 if it were developed by interplay which would play like a 1996 game .
Its funny how interplay is trying to claim this title after bethesda revived it with fo3 which was very good and gained a much bigger fanbase rather than trying to please the nerds/fans of the previous games.
Whatever mmo that interplay is currently developing... That shit is going to fail when it comes out.
Anyway new vegas is coming out this year and i bloddy cant wait to get my hands on it. Mad props to bethesda and obsidian.

I find it amusing you basically say the old Fallout games are for nerds and crappy, then praise Obsidian and say you are looking forward to New Vegas which is basically designed by team members from the original Fallouts who formed Obsidian.

@StingingVelvet : i never said that the old fallout games are crappy .FYI im a huge fan of games like diablo and planescape. I was only commenting on the way interplay is trying to bank on the fallout series after the success of fallout3. :) . Either way FO3> fo 1&2 . Remember... u could finish fallout1 by just evading all the enemies. ^_^ .

...and that's a bad thing because? FO1 and FO2 offered a RIDICULOUS amount of options and far more than FO3. You could even decide to be a friggin' porn star! You COULD kill children but you'd be attached with the stigma of 'Child Killer'. FO3 isn't bad, though nothing could match the sheer scope, majesty and wide-range of things to do than the first two Fallouts.

@RIMoonlight I honestly don't see Fallout 3 as being in the lineage of the other Fallouts. The whole game is suppose to be about the decadence and survival of the world in an after math of nuclear war. I never really got that impression with FO3. In FO3, I felt alone most of the time where as in FO1&2 you often run into a lot of random encounters which made the world feel populated and unique. In FO3 you were only likely to encounter SET PIECES which had barely an inkling of the felling of FO1 or 2. It wasn't dynamic enough it didn't capture the setting or the general day to day drama. Not to mention the difficulty, unless you beelined for power armor.

One simple mistake and it was over in FO1or2. Really bad numbers and you were dead.

FO3 is just some mainstream trash, I honestly don't think it even compared to Oblivion.

Meh... I didn't like Fallout 3 that much. It was fun, yes, it had great atmosphere and all, but it wasn't like the others. I mean, sure it got my friends interested in the world of Fallout, so much so that they learned a lot of what happened in previous games, but they won't play the other fallout games because they are too dated. They can have their Oblivion with guns, I like my true Fallout. Also, if anyone can make a proper Fallout MMO, it would be Interplay. Bethesda can make their Elder Scrolls MMO, Interplay can make their Fallout MMO. Everyone would be happy :D

That would be the Interplay that were responsible for cancelling Van Buren (Fallout 3), killing Black Isle studios, and developing Fallout: Brotherhood of Steel instead, right?
