Idiot sues Bungie and Microsoft over Halo 3 photo

Randy Nunez is a man on a mission. A mission to make Microsoft and Bungie pay for their crimes against gamers. Despite Halo 3 being a relatively well polished, complaint-free game, Nunez claims that he is one of a great many people who have encountered game breaking glitches, and he wants his day in court.

"Halo 3 does not function with the Xbox 360, and to the contrary, attempted use of Halo 3 consistently causes the Xbox 360 to 'crash,' 'freeze' or 'lock up' while the game is being played." alleges Nunez. The suit also claims that there have been "mounting" complaints about the game, which neither Microsoft nor Bungie have seen fit to address. There doesn't seem to be an explanation as to why this complaint is happening in 2009 when the game was released in 2007. 

"Because Halo 3 is not fit for either its ordinary purpose or for the particular purposes for which it was sold, defendants have breached the statutorily implied warranties of the Song-Beverly Consumer Warranty Act," the suit continues.

This is absolutely ridiculous. Three years too late, and simply very wrong indeed. The very fact that something like this could even get filed is evidence enough that America's legal system has been f*cked by too many stupid people clogging it up with frivolous, greedy idiocy. I hope this guy gets humiliated.

Maybe if he would stop licking the television screen and stop sticking pancakes into the 360s disc drive, then he wouldn't have a problem. But I also recall someone on some podcast saying on the lines of "Halo is for idiots who like act stupid" and I couldn't agree more.

hey try this email the president to allow for tort reform, what you cant do that that would mean Bush was right for sending several bills to congress on tort reform. It isnt so much the idiots that file the lawsuits as it is of the greedy lawyers incouraging the suits to make a quick buck. there are more lawyers in this country then doctors. Dont this make you think of why?????

Come on you all, please quit making exscuses for this guy and his lawyer. the wole point and only point is GREED and a court system over the past 25 years that allows all these worthless lawsuits with out any punishment for false or unproven facts.. you all know we can go to court and file a law suit on anything or anyone with out a single punishment if we loose.

to be honest , the first time I played Halo 3 my XBOX 360 broke, lol. And so did the game inside the system. But I'm not going to be a little girl and sue over it. I just got another copy and sent my XBOX to be fixed

Laugh because it's compeltely ridiculous, sad because people are foolish/greedy enough to try it. Now, I'm ignorant on law, and law related topics, and maybe something like this exists, but it makes me wish that once this fool gets his ass handed back to him for being stupid, Bungie and MS could counter-sue for "unnecessary harassment" or "wrongful conviction" or something. :P

I agree. I see this as nothing but greed. I don't like the 360. I hate Halo, for multiple resons. I despise M$, but the fact that this douche seems to be only after money is a fucking shame. What he should really do is just stop playing the game if he is going to sue the company that made it, I mean WTF? I don't like this cunt maggot, and I hope he rots.

'Your honour, I would also like to point out that in addendum to this lawsuit I have identified other offences in order to prove Halo 3's faultiness.

Attempts to lay down arms and bargain with the aliens in Halo 3 always fail. Repeated attempts to lay down the controller and shout at the TV "I'm unarmed! I mean you know harm!" always end in death. I am never entered into peace negotiations or, at very least, taken hostage. Sure signs that the game is broken.

For this reason, I am suing for an extra zillion dollars for the miscarriage of tragic judgly justice.

There seem to be a fairly large group of people who are having problems with Mass Effect and Fallout 3. Lots of random crashes, patches that take forever to come or only add achievements when they do arrive. These are problems that have been documented since both of these games launched. If a class action lawsuit was filed against Bethesda and Bioware for this they might force a settlement.

This guy is just going to lose a shit ton of money in legal fees if this doesnt get thrown out of court.

This isn't a problem with the legal system. It's a problem with a few bad lawyers who don't really understand what they're suing over. Getting filed isn't the same as getting before a jury, people. This case will be dismissed and out of the judge's hand before he can even finish reading it (especially is he has a younger male clerk that has likely played the game). Almost zero time wasted by the courts, but plenty of money wasted on the part of this asshole.

As I said, this is a case of a bad lawyer who doesn't really understand the principles he's working with, and is trying to make a name for himself with a "big" case. Plus, I almost guarantee he's hoping for a settlement, which I sincerely hope he does not get.

I'm constantly surprised that anyone has played this game longer than the first mission. I want to sue Microsoft for brainwashing me into buying it in the first place. It had to be mind control, because it certainly wasn't quality gaming.
