Artists influence each other all the time. Sometimes that influence is more obvious than others, but it's always there.
Lifting bits of art is a bit more questionable, but to the extent seen here it's absolutely nothing to get anyone unleashing the lawyers over. Just shows some lazyness. Redrawing the same thing would have been acceptable and taken just a few minutes.
This looks like an artist who happened to be a Star Wars fan and wanted to have a reference to that particular poster in the game for other Star Wars fans to enjoy. A few years ago, we would have called that an homage. Today, we're using the same terms to describe this as we used to describe the people who directly lifted assets from Diablo and Torchlight, without modifying them in any way.
This is how things work and I'm quite glad to see that this guy is just trying to call to attention that this was his, and hope for them to say, "yes, we did this, possibly on purpose" and then move on. That's how life should work, not people running to the courts.
Now, Olly Moss is pretty established by this point, as an artist, but that's not the point. Even if they didn't copy the trail of smoke (which they did), when they replicated the concept of his Star Wars piece without his permission (which he probably would have given), the person responsible revealed how goddamn out of touch they are with working artists - similar to almost everyone here in this thread.
Yes, you do not own an idea to the point where you can sue someone if it's mimicked (or even in this case with actual assets stollen as well), but it's shady fuckin business to rip that off. Largely because working creatives in the field spend so much goddamn time trying to come up with a good idea that serves the project that most of us are paranoid that someone else did it first. We research intensively and familiarize ourselves with all sorts of new work coming out to minimize the chance of stepping on another artist's toes. It's a matter of respect, and I'm bummed that likely several people at Gearbox didn't care about respecting another artist.
But, as Olly Moss has made clear, this isn't worth getting angry about. It's disappointing, but people's reaction here is indicative of the same flippancy that likely got this rip-off green lit.
Reading his twitter it sounds like he isn't even "looking for acknowledgement" as Jim suggests. His comments are just that he's disappointed because he didn't get to make it himself because he loves Borderlands and would have jumped at the opportunity.
...And some minor finger waggling for lifting the zig-zag clouds.

Catchlines are jokes that you may or may not get, but the people that get it are aware of the homage. Ripping off a graphic design that's relatively unknown is ripping it off. If they'd done it like one of the original Star Wars posters, that's obvious, it's iconic.
Not really that blurry of a line but one that people here don't seem to understand the difference between the two.
Sure the silhouette against the landscape has probably been done before, but not in that exact way with the wavy lines and the ship. And BL2 copied the concept exactly. Im not saying it was right or wrong, just pointing out that they did more than just use a similar concept - they used the exact same concept.
I'd normally agree with your sentiments but you really should take a closer look at the picture, an aspect of it looks as though it's been directly lifted...
Or of course it could be as simple as one guy ripping another off. Just presenting other possibilities.
The zig-zag is directly lifted apparently, and that's one element. These other elements were not only lifted in concept, but the entire concept itself was lifted.
