Court stops Bethesda from blocking Interplay Fallout photo

It seems that the battle over Fallout is over... for now. A U.S. District Court judge has denied Bethesda's motion for a preliminary injunction against publisher Interplay. The ruling came down this week and was discovered by Duck and Cover, but has been confirmed by more reputable sources as well. The ruling means that Interplay will not only get to continue to sell Fallout 1, 2 and Tactics on its own, but can also continue to make the Fallout MMO that we got a peak at thanks to the case.

If you've been following the case you know that this is a pretty big set back for Bethesda, who claimed that Interplay was confusing customers with its packaging of the Fallout trilogy and also was not living up to its end of the bargain when it came to developing the MMO. Neither company has reacted yet to the ruling, but we're sure to hear something from someone's lawyers at some point. Most likely this isn't over, but maybe Bethesda will back off for a bit.

Bethesda sounds butt hurt over the whole thing and Interplay was 1st and by far better.

I -like- Bethesda. But I don't really feel one way or the other about this. I loved Fallout 3, couldn't get into Fallout 2, and didn't try the first game.

As long as there's a new Elder Scrolls game in the making, I'm happy.

I'm not emotionally invested in this argument, but Bethesda did buy the IP. I suppose buying the rights to the rest of the series was either too expensive, or they didn't think that far ahead.

This won't make a difference. The Fallout MMO will almost certainly never be finished. Interplay were a great company once..... a long time ago. Now, it's a wrecked shell of its former self, barely able to produce anything, disorganized, dispirited and lacking in direction. Even with the massive amount of money they gained by selling off the Fallout IP, they still couldn't pay off all their debts.

Interplay is sunk. Like Midway, they will totter around on the stage for a few more years, grasping at the memory of their glory days. But the fact of the matter is that Interplay haven't released anything in many many years, they have made almost no progress towards making any sort of game fit for release, and they probably never will.

I know many Fallout fans say that Bethesda has "ruined" the fallout franchise. I disagree but I understand that nostalgia is a powerful force. However, even the most ardent fallout fan must realize, surely must realize, that Interplay were NEVER going to do anything with their Fallout IP. Before they sold it to Bethesda, they were many millions of dollars in debt and had no funding and were a skeleton company. Their capacity to produce a fallout game was nil due to the fact that the company had been so badly mismanaged.

I don't understand - if Bethesda hadn't picked up the Fallout I.P, Interplay wouldn't have even had the CHANCE to develop the MMO. No matter what, Interplay was never going to, and never could, have released another fallout game. Bethesda didn't steal anything - it actually saved Interplay and the fallout franchise, for without Bethesda's money, Interplay would have shut down a long, long time ago. And you can't blame Bethesda for Interplay's lack of progress.

Bethesda should have paid more and just bought everything related to Fallout instead of buying a piece of it and then hoping a court would give them the rest.

I really don't care as long as it means we still get new Fallout IPs from both companies. Regardless of what some feel about Fallout 3, I loved it and can't wait for the next one. But, I also can't wait to see what Interplay does with an MMO. We really need a more futuristic set MMO, and fallout has the right amount of various storytelling aspects to make for an enjoyable setting.

@Korolev - I don't think people prefer Interplay's Fallout games for nostalgia, I think they prefer it because, you know, those games never released as the buggy shitheaps that Bethesda is known for.

Bethesda seriously needs to learn what quality assurance is.

@The Silent Protagonist: Except that they're really not that bad. I never had more then a hiccup of two in the <I>250 hours</I> that I played that game both on PS3 and the 360.

Everyone flips out on Bethesda saying that their games are buggy but I literally NEVER have a problem. I don't know what the hell you guys are doing to your games to break the shit out of them... But maybe you should try playing them like a normal person.

Also, New Fallout > Old Fallout by leaps and bounds.

Huh. Well, whatever. Fallout 3 was fucking awesome. Why don't they both just move on to make other games and let the PC fans have fun modding it to death.

First off, don't comment if it dosen't involve the actual article. Second, I understand Interplay made the first two Fallouts. Good for them. Fallout 3, though, is amazing. 3D, FPS, just beatiful. I want a 3D FPS MMO. Not some click-and-move MMO. Personally, thanks to Bethesda, I want to play more fallout games. And from some of the concept art/screenshots of Interplays Fallout MMO, it looks... Incorrect. THere are tree's. Even thought they are burt, if the world got nuked, there shouldn't be any trees. Buildings maybe, but no trees. Plus it looks like Fallout 3, but lower graphics. Interplay, drop the Fallout MMO title. Please.

@Silent Protagonist: You're seriously trying to claim that the original Fallout games weren't buggy, or that Fallout 3 was any buggier than they were? Did you ever actually even play Fallout 1/2? Some of the buggiest games out there when they first released, and were NEVER fully patched (except by fans).

Interplay is a joke of a company, they're the ones that ruined Fallout, I can't comprehend why any of you would go to any lengths to defend them.
