Brazil plots to have game making a criminal offense photo

Brazilian Senator Valdir Raupp is no friend of videogames. In fact, he finds them so offensive that he recently drafted a bill to make it illegal to make, sell or import any videogames deemed troublesome in the eyes of the Brazilian government. Rather than deal with real criminal issues, the Senate has approved the proposal, which means it will now be voted on in the Committee on Constitution and Justice.

Raupp aims to "curb the manufacture, distribution, importation, distribution, trading and custody, storage, the video games that affect the customs, traditions of the people, their worship, creeds, religions and symbols."

"Therefore," he continues, "we seek to protect the principle of equality -- for many the greatest of constitutional principles -- with the characterization of such discriminatory conduct as a crime by making provision in the law."

Brazil has banned games such as Carmageddon, Postal and Grand Theft Auto in the past, and if Raupp gets his way, many more bans will follow. Anybody caught breaking this law could face up to three years in prison. Yes, prison -- all for the crime of making a videogame.

This will never be approved by the Commission on Constitution and Justice. Even if so, I doubt it would be sanctioned by the president (bad as he is). Even in the unlikely case this project gets sanctioned by the prez, the Federal Supreme Court would certainly smash it as unconstitutional.

I LIVE here and I don't see any of this take action. Everyone here's played Grand Theft Auto - I wasn't aware it had ever been banned. If they ban another game, everyone's gonna simply pirate it, and nobody is gonna care.

So yeah, here and possibly Australia are the worst places to be a gamer in.

Wow, thats some powerful nonsense. A supposedly modern democracy demanding the right to censure a form of media, is acting more like some tin horn banana republic. Its times like this I feel luckier than ever to be an American. I can only hope this Raupp is some sort of fringe lunatic within the Brazilian political picture, and that this is just some isolated incident.

At least this sort of non-sense isn't prevalent here in the states as much as it used to. The media gets uppity ever once in a while, but they seem to have adapted by and large. Many news outlets, and even congressional members lost their minds over GTA III. Pretty much only Fox News gave a shit about Mass Effect's sexscapades, and even they couldn't be bothered to really breathe a word about Dragon Age's similar content. Even Modern Warfare 2's "No Russian" level didn't get quite the coverage I was fearing.

Its good be able to literally see societal progress within my own life time, and that our culture is moving towards understanding that video games aren't just for children. That deciding what's acceptable in terms of content should be left in the of consumers and the market place, not a group of worthless political hacks looking for their chance to grandstand in front of the cameras.

I'm brazillian too and I think this asshole is being offensive. I want to pursue a carreer of a game developer and with obstacles like these I'd rather live in another country. But, Leo Modesto is right: I went downtown this wednesday and saw GTA on retail for PC and PS2. They are actual legitimate copies. Also, Persona 4...

HiddenAHB is also SO right. Gosh, taxes here are like +60% over ANY imported product plus other ones I'm not familiar about.

Hah, let them approve it. Piracy is so rampant in Brazil I'm surprised anyone even buys original software there. Did you guys know that just recently the PS2 was "officially" launched over there? With a price of something around $400.

That just means that the games will still get in and be sold, by other retailers who don't wait for the "official" release.

Normally it's dumb if a game gets banned, but not the end of the world because international shipping and didgital distribution exists. This however criminalises every aspect of gaming and is therefore some large backward thinking shit.

Wait, what? So 72% taxes weren't enough? Even though there is some nasty things against games here, I don't think this will be aproved.


And GTA was banned here? Like, yesterday? Counter Strike was banned (though you can still buy it on Steam), and I don't doubt Carmageddon was too, but I if you go to a any game store here, you will find GTA games. I also saw Postal 2 here some years ago.

IF that law passes the first semester will be hell to find a importer willing to sell any violent games and then when things cool down it will be back to be like it always have been, the "good" thing about it is that usually here in Brazil politicians don't tend to hurry things up when they don't lead them to more money, power or votes. My only real worries about this law passing is that I fear game prices will go up very fast.

They're including making/importing/selling "offensive video-games", in the law that criminalizes racism. So, making/importing/selling is as big as not allowing a person enter an stablishment 'cause of it's skin color...

Also, read a fraction of the project:

I really dont understand how so many of my fellow gamers fail to see why some people(or governments) dislike media so much. You are what your exposed to and with both parents doing the 9-5 leaving kids on their own, theres some REAL nasty shit in a lot of games these days that shouldnt be exposed to children. Specifically something like GTA or Manhunt or Convicted, you wouldnt let a child watch corresponding movies(Scar Face, Sopranos, Saw).

Although if you do think a child should be into that stuff at a young age, you must either be 13 or fucked in the head. Either way, youd also have to be American(probably southern).

The whole "Doing this instead of actually worrying about real important stuff" angle is even more apt here, since Rio won the Olympic games. Rio also happens to be a giant crime-filled pit, on par with Cyberpunk fantasy cities in levels of rich and poor disparity and street violence. They need to get that under control and also build a stadium + Olympic village.
If some Olympic athlete gets shanked Brazil is gonna be soooo fucked.

@Jetsetlemming There's already a lot of stadiums that were already built. And though Rio de Janeiro really IS violent, it's not like the media calls it to be. And sice this is a cultural aspect of the city, it just impossible to simply remove the slums and stop the violence until 2016.

which i belive i what the law is about: "he video games that affect the customs, traditions of the people, their worship, creeds, religions and symbols." i dont see violent games specificlly enter in this segment...

But thinking about it games like Dantes inferno,DMC,bayonetta.....lets hope for the best T-T
