The foxgirl Xiaomu (and her partner) from Namco v Capcom were original characters that I would safely assume that Namco have the rights to. Since KOSMOS was also from a Namco game, and that Banpresto is a part (I think) of Bandai/Namco, you can bet that it was easy to overcome any licensing issues with those characters.
