About Me

Currently Playing:

...Alot of stuff

I like to fap...a lot.

I have been on Destructoid for a little and have grown to really love it's community. I love to write articles on gaming and I find it easy to do with Destructoid. I am currently studying a Bachelor Degree of Communication (Journalism), so that one day I can hope to do this professionally.

While studying I jump from job to job like crazy because I don't want to do anything but write, and while that may sound reckless, I assure you that I really couldn't live any other way if I tried.

I just want to say thanks to everybody involved with Destructoid including every reader, community blogger and contributor. It really is an amazing place in the digital, shit infested swamp lands of the internet.

I am a proud member of the Refused Classification panel also consisting of Destructoid members Puppy Licks and DanMazkin, which brings to the plate a fortnightly Destructoid only podcast and soon to be video content which will also be featuring guest appearances from gaming celebs such as the Masterchief.

I also write on Stereotoid; a weekly shift in the Earth's crust where the greatest music from all time seeps forth and pushes its way into our ears then forces us to write about it through mental fuckism. If you understood that, then well done.

P.S - One day I will write for Destructoid...That's right Niero! I'M COMING FOR YOU MOTHER FUCKER!

Pseudo-Wit Dtoiders (In relation to Yahtzee Sells Out...WHY!?)
Samuel Dillinger | 11:25 PM on 07.10.2008 10 comments

After the great feedback I recieved from my last post I decided to back this one up with some short facts that will address all the pseudo-wit filled comments that all you smart gentlemen decided to bless me with...

First off, let me just clear up something for all the people who believe things have been changed due to copyright reasons. This may be speaking about photography and imagery but it also applies to any created art...
---------------------------------------------------------------------------------------------------------
Fair use on the Internet

A US court case in 2003, Kelly v. Arriba Soft Corporation, provides and develops the relationship between thumbnails, inline linking and fair use. In the lower District Court case on a motion for summary judgment, Arriba Soft was found to have violated copyright without a fair use defense in the use of thumbnail pictures and inline linking from Kelly's website in Arriba's image search engine. That decision was appealed and contested by Internet rights activists such as the Electronic Frontier Foundation, who argued that it is clearly covered under fair use.

On appeal, the 9th Circuit Court of Appeals found in favor of the defendant. In reaching its decision, the court utilized the above-mentioned four-factor analysis. First, it found the purpose of creating the thumbnail images as previews to be sufficiently transformative, noting that they were not meant to be viewed at high resolution like the original artwork was. Second, the fact that the photographs had already been published diminished the significance of their nature as creative works. Third, although normally making a "full" replication of a copyrighted work may appear to violate copyright, here it was found to be reasonable and necessary in light of the intended use. Lastly, the court found that the market for the original photographs would not be substantially diminished by the creation of the thumbnails. To the contrary, the thumbnail searches could increase exposure of the originals. In looking at all these factors as a whole, the court found that the thumbnails were fair use and remanded the case to the lower court for trial after issuing a revised opinion on July 7, 2003. The remaining issues were resolved with a default judgment after Arriba Soft had experienced significant financial problems and failed to reach a negotiated settlement.[/color]

Still not convinced? This was taken from the official Austrlaian Copyright Council website:

Dictionary Meaning of
Substantial
Adjective
1. of a considerable size or value: a substantial amount of money
2. (of food or a meal) large and filling
3. solid or strong: substantial brick pillars
4. Formal available to the senses; real: substantial evidence

Last I checked, Yahtzee used only VERY short sections of copyrighted music, posing no threat of possible lawsuit, esepcially due to the fact that he credited the songs used and the artists who performed them.
---------------------------------------------------------------------------------------------------------
Ok, now that the copyright issue is out of the way, lets get to the people who managed to bring up decent points but seem to have completely overlooked mine...

TO UGLYPHIL: While I respect what you are saying, I don't consider you to be a fan boy because you yourself admitted that you are not happy with the changes. However, my 'rant' as you like to call it was something written out of dissapointment and not hate towards Yahtzee. More so to do with the fact that The Escapist are fucking with his talent and he deserves better than that. This was not a direct crack at the man behind the works (who openly admits he has sold out before even making videos for The Escapist). And for the record, you called me an e-peasent for wailing about my dislikes about what Zero Punctuation is becoming...what do you think Yahtzee does in his reviews? I guess it's ok for him because he does it in a more user-friendly, fashionable and entertaining way.

TO SILVERDRAGON: Yahtzee admits to selling out himself by riding on the SS Sellout in the second video posted. My arguement was (and it is clearly written in there) that I don't mind if Yahtzee gets paid for what he does, In fact I am happy for him because he deserves to be paid because he is talented. However I do mind when the people who pay him restrict him from being the creative mind he is. Which is slowly what is happening.
---------------------------------------------------------------------------------------------------------

Ok, that deals with all the reasonable arguements people decided to bring to the plate, now lets deal with all the fuckheadism that came soon after that:

TO TIMMEH: There was a point, I just explained it to SILVERDRAGON above, if you are too blinded by your idocy to see it amoungst all the abuse I wrote (which there is a alot of considering I hate creative processes being fucked with by people with bags of money), then dont try to justify it by creating your own 'point' that I am trying to get accross. You say I have no point, then you try to sarcastically mock me by assuming that my point was that I can't stand the fact Yahtzee is getting popular. Youre a dick.

TO BLEHMAN: You knew the points I was trying to make by comparing Yahtzee to the musical artists I mentioned in my blog yet you seem to want to bring out the measuring tape to start comparing dicks when it comes to music and selling out. You are creating a bullshit rebuttal to an example that was used in trying to make it easier for people to understand my fustration in where Zero Punctuation is obviously heading. But if you feel the need to express your mighty l33tness when it comes to musical knowledge, go right ahead, im sure the many legions of followers will be lining up to suck the shit spill out of your digital, multi-blogging-commenting-arse. Round of applause for the music man.

TO TECHNOPHILE: Obviously I do give a shit about what people write back otherwise I wouldnt be writing this now would I? A pointless rant which addresses what happens to something creative once too many people start getting a whiff of it. I'm sure it has happened to something you have liked in the past, and it doesn't stop you from liking it just as I haven't stopped liking Zero Punctuation (I never stated anywhere in my last post that I hated it), however it does piss you off when the thing you love gets fucked around with by the people higher up causing changes. Also last I checked, all blogging is practically a bunch of equally useless cult followers expressing their love, hate, annoyance and dissapointment in all things related to that culture. That being said, I can write whatever I want, wherever the fuck I want. STFUASFSDFJSEFNDKVMDLMVDLMDLMCM..anus.

TO ALI D: I am well aware of what was written at the end of the last Zero Punctuation because every video I pause to see what he writes because I find it hilarious. Yahtzee has admitted many times to selling out, but he has never let selling out change his creative process until now. And seeing as though you know me so well, my video editing company and full time study are going great. Thanks for your concern fuckhead.

TO REDZIE: You make a fair point but you seem to miss the fact that I praised Yahtzee in my last post and am upset with the obviously forced changes he has had to make due to the people who pay his wages. Why would I stop watching it when I still enjoy his creativity?

TO HERETIC: Being somebody who has obviously been on Destructoid for a significant amount of your natural life I feel the same amount of respect for you as I do pity. You try to make ME out to be an Elitist prick when all you seem to be is just that yourself. Maybe instead of addressing your faults in other people, you should address your faults within yourself. I also think you took my post the wrong way, but maybe you can't see that well due to your head being stuck so far up your own arse. Fact of the matter is, I have you on my friends list because I enjoy your posts and you have some entertaining material, but regardless of how much I like somebody, I'm still going to let them know when they are being a kiddy little fuckwit (and obviously you do the same). I guess this is just one of those times. Your part in my (and everybody else on destructoid's) life is very small, so however high up you think you may be, just reside in the fact that your 'l33tness' takes up the same amount of time in my day as laying a fat shit. Regardless of this, I still salute and respect you.
---------------------------------------------------------------------------------------------------------

Also, Blehman, I hope you realize that under current copyright laws it is illegal to reproduce full written works without licensing. Here are some pointers for you:

Just be sure Maynard doesn't catch on, I've been told he is a bit of a cunt when it comes to things like that, great voice, great band but also a cunt :)

Well, thats it from me, I'm sure none of the people I was hoping to address are even going to read this, but I'm just recovering from a big night out so I didn't really have much else to do while in recovery mode except fap a few times over Sunny Lane's first anal film and get high.

Don't be sour at me people, I respect all people on Destructoid to some degree and just because I decided to bite back the people that chose to bite me doesn't mean I think they are not worth my time (otherwise i wouldn't be spending my time writing this). In the end, I may be a pesimist and a cunt, but I also love you all because you are all in here for the gaming and the lulz.

I tip my hat to you all,

Goodnight
Much love & respect (obviously)
Moses

P.S- Ever stop to think that this seems to be a Domino effect kind of situation...Yahtzee bags out games, I bag out Yahtzee (or so people seem to think), people bag out me...Quite amusing really.

"And for the record, you called me an e-peasent for wailing about my dislikes about what Zero Punctuation is becoming...what do you think Yahtzee does in his reviews?"

It's about intent and product. What does the creator put into it and what does the reader / viewer get out of it? Yahtzee does the videos for lulz and for the money. The viewer gets entertainment and/or validation. Even if the above wasn't true, his rants would still be intelligent and unique. But ill-informed rants do little to benefit the Internets as a whole.

You'll notice how, in my Review of Peas, I tried to make it fun, I attempt to give the reader something unique that they couldn't get somewhere else. The point I was making that if you're going to make these blogs, make them GOOD. Do you have any concept of how many people did the same thing? Are you going to be any different from them or are you just going to make another carbon copy hate speech?

Just don't be so reactionary. All he did was change the music. I winced at it, sure, but I'm not declaring that he has sold out yet. When he starts getting sponsored by Branston Pickle and when he starts getting his creativity stemmed by his evil captors to the point where all entertainment is reduced to a gritty useless sediment is the time I'll stop watching the damn videos and will change the name of Yahtzeeday back to Wednesday.

I'm really not a fanboy.

NOOOOOOOOOO NEEEEEEEEEEEEED!!

Seriously man, I didn't say anything in the last post because, well, you had an opinion on it and that's cool and all. But there's no need for an entire new blog just to retort to the things others have said!

On the topic of the last blog though, in an attempt to try to instill some relevance here, I think that your definition of "sell out" is pretty harsh. That's like accusing DToid of selling out because it runs adverts or something. Chill, relax and enjoy it all when it's good. He's not infallible!
