I'm trying not to just laugh at this most recent legal battle Mr. Estavillo is attempting to pursue. He failed suing SONY, and now goes for MS and Nintendo, for $80k worth undue stress and sadness.

[i]Erik Estavillo, the Resistance: Fall of Man gamer who sued Sony Computer Entertainment America (SCEA) over being banned from the PlayStation Network has targeted the remaining two major console makers in a new lawsuit.

Microsoft Corporation and Nintendo of America are defendants in a federal complaint, which was filed November 18 in the U.S. District Court, Northern District of California.

Microsoft is being sued for a “red ring of death” affecting the plaintiff’s Xbox 360 console. Estavillo notes that as he is disabled, he cannot afford to pay the “well over $100” fee to fix the console, nor can he afford to purchase a new one. He feels “that Microsoft should have to bear the burden that is now put on the shoulders of this disabled plaintiff.”

Estavillo is seeking $75,000 from Microsoft, due to the “undue stress” he has undergone since the 360 broke and the “sadness he will have in the mean time of finding one he can afford.”

The same complaint targets Nintendo over a Wii system update. Estavillo claims that update 4.3 disabled his Homebrew Channel, which he used to unlock characters in Mario Kart Wii. Plaintiff states that the only way to unlock characters in Mario Kart Wii is to purchase Super Mario Galaxy, which will unlock a single character in the former title. “In essence, Nintendo is forcing customers to buy another game to unlock one character in a different game.”

Damages to the tune of $5,000 are sought from Nintendo, for interfering in plaintiff’s “pursuit of happiness.” An injunction is also being sought to prohibit Nintendo from “deleting, blocking or prohibiting the Homebrew Channel and Ocarina applications.”

Estavillo says he suffers from depression, obsessive-compulsive disorder, panic disorder, agoraphobia and Crohn’s disease, all of which lead to his leaning on videogames “heavily” for happiness.

Estavillo plans to file a lawsuit in state court as well, which he wrote will “pretty much” be identical to the federal suit.[/i]

Zombie musings

I wonder, do zombies ever have thoughts as they meander down the roadside, besides dining upon brains and guts? Do memories of past life experiences flood back to flash back to them in a burst or do whole scenes unfold before them? Can one trudge down a path in the sun and feel the warmth somehow hoping to gain a brief respite of the undead pain they endure, hoping to catch a taste of times past.

Are zombies racist against other zombies?

Do the undead raised from slumber by voodoo, feel hatred for those bit by an angry monkey? Does the lumbering shamblers who can only compete with the speed of a tortoise, despise those that are quick and nimble?

Can or would a zombie rebel against fellow zombies and try to side with the living?

I guess I'll never know

It's almost Halloween!


What are you going as?

I'm broke so Ill be going as a zombie to work. Everyone else in my department is doing a gangster/flapper Roaring 20's theme, but I like to go against the grain. Somebody suggest a vampire family and I lol'd at the Twilight inspired idea of sparkling vamps roaming the certified mail offices. I also cried inside a bit at the idea.

I'm going to miss my friends up north as we had fun times with Halloween costumes. The bland blah-ness of my co-workers ideas are very depressing.

So D-Toids, what are your co-workers doing that make you feel bad for the best holiday of the year?

Nintendo and Sony
I've got a C64, Atari 2600, NES, SNES, N64, DS, PSX, PS2, PS3, PSP and a Wii. I keep all my games and won’t trade them in :D Although the C64 and NES are lost to the ravages of time and moving.

• I dig most JRPGs and a few Western ones as well
o Any Final Fantasy (Mystic Quest included)
o I played a lot of the Gold box RPGs from TSR as well as the old Bethesda TES Games
Fighting Games in General are bad ass
o Any Street Fighter or Capcom vs games are winners IMO
• Some FPS games. I was a big fan of the original Quake, Half-Life (not counter strike though odd enough. I played a lot of Battlefield 1942 and looking forward to 1943. Don’t like the Haylos
MMORPGs I played the shit out of most SOE MMOs games. In fact I worked in SOE technical support (TSR- TrevorG on the official forums) for about a year, than we parted ways. $10/hour OUCH

(FYI I can't stand WoW. Yes I played it, got to 25 on 4 classes, and just didn't like the overall mechanics and playerbase/community.)

Strategy Games Give me some classic X-Com or something akin it.

Music wise I’m into metal, rock, punk, some hip-hop (not rap, there is a difference), jazz, classical and soundtracks to movies and games.

I spent some time working at SOE in 2008 as a customer service/technical support on the forums as TSR TrevorG. While I probably wouldn't go back, there are some great guys and ladies working there. I even play a weekly D&D game with them still on Sundays.
