The plaintiff, Randy Nunez, is seeking seeking class-action status along with $5 million in damages plus costs and attorneys' fees.
The suit claims that "many consumers" have these issues, making their console "totally inoperable." The court papers cite "industry Internet web sites, weblogs, and message boards" to prove that this issue is a common one. It also alleges that Microsoft and Bungie have "received numerous complaints" from consumers on their phone lines and service forums without admitting these alleged Halo 3 issues to the public.
Why $5 million? I've never understood our court system. Like some girl burns herself with coffee and gets $9 million or however much it was. I would just sue for how much my hospital bill was, thats all they should pay. If I sued Microsoft, I would just want them to repair my broken console for free....maybe throw a game in there too.
I hope his case gets tossed out. While there's some basis for a crashing xbox due to hardware failure, I've never seen or heard of hardware failure due to Halo 3's interference. If this is the case, I'd sure like to see some evidence of this, since there's a large majority of us NOT having these problems online with Halo 3.
