Until they start obfuscating or putting encryption in their QR codes the fact that one game can read QR codes for another game is sorta meh.
Not going to pretend this game is anything original .... I dunno maybe its the fact that I got all angry about all the minecraft clones then I realized its pointless to be angry because unoriginality is rampant (read: I got over it).
And the most original Ideas I have seen come from people taking ideas from several different games/elements and combining them in new and interesting ways.
And people like me who doesn't got a 3DS can play the game. It's perfect.

The question becomes, does Pushmo use a standard format for conveying data? OpenOffice can read documents created in MSOffcie, should the world now end?
One of those two is free and they are both clones of WordPerfect.
Hell more than half the user generated content for Pushmo seems to be taking known IPs and turning them into Pixel art.... how is that original? Yeah its fair use but original it is not.
And for that matter Pushmo seems to have been heavily "inspired" by Catherine..... so......... yeah.
I dunno, is it this guys fault that people would rather play a simple game like this on their phones than they would on a seperate device? Nintendo isn't adapting to the modern world. If they wanted to put their games on iOS or Android they would, but they don't. At this point the "mobile" market is completely seperate form the handheld market. This guy is providing his own version of the game to people who would otherwise be unable to play it, I don't see what's wrong with that so long as he doesn't make a dime off of it. If Pushmo was already available on android and this guy was charging or running ads to profit off his clone then I'd see an issue, but as is it's just a nice alternative for those that don't have a 3DS.
As for the QR codes, if they wanted them to be more secure they could have been. An alternative would be the ability to just take a picture of some pixel art and auto-generate the map. It's a non-issue in either case.
The "developer" even commented on GoNintendo to state, that his only intention was to practice developing games and he really admires Nintendo.

Yes, but the gameplay between Catherine and Pushmo aren't exactly the same. Arguably pretty different. I mean, yeah you pull blocks out to ascend, but in Pushmo the puzzles are based around pictures, you aren't just pulling out squares, you aren't avoiding enemies, etc. Plus the entirety of Pushmo's gameplay is based around this.
Now... BlockShift, on the other hand....
We're not talking about this "BlockShift" being inspired by Pushmo, we're talking about it completely, undeniably ripping it off. I mean, look at it. It doesn't seem to be changing it at all and it even has that same sort of camera angle. Only difference is the crappy flash aesthetic.
At least it's free.

What about fan films? We see those all the time.
But once you make it interactive, and just like fanart and fan films, release it for free and for fun, you're not just a fan, you're a thief?

This isn't exactly fan art. Originally it was described as a unique puzzle platformer, giving the impression that he created the idea. Lots of people said that it was a fantastic time waster, some wanted to donate money, and other said that why buy dedicated handhelds when you can get games from talented developers such as this. It's impressive that he was able to copy the game down to the QR codes, and i don't think he meant ill, but still, it's not right and it's taking potential sales from the game. I'm all for fan art, fan films, fan projects, etc. But when you are copying a game without adding anything substantial that is still in the market, you are doing more damage than good.
Would it have been any better or worse if they had gone with a desert/pyramid theme for their base block set and called it pharaoh or the likes?
It will be a sad day when and if you can ever copyright/patent a game play mechanic because that is the day ALL originality dies. As nothing is "original" everything has been done before all you have in reality is the application of existing mechanics in novel ways.

And games can borrow mechanics. That's fine. But, when we have two games that entirely revolve around the same exact novel mechanic, it's a bit different.

You act like BallsShift took a gameplay machanic from Pushmo and used it (like regenerating health from Halo or the lock on camera of Zelda: OoT) which is not the case, it copied the gameplay almost 100%.
I'm well aware of how much I suck, but im just one developer(1 man developer) who was inspired by everything Intelligent Systems and Nintendo make.
I'm not saying this is my idea at all. I made this game only to test myself to see what I can do on my own.
I saw a lot of people's complaints about pushmo and I tried to add a few (online database for level sharing, special blocks(vines and hopefully a lot more to come), convert images from your gallery and convert them to levels) changes to make the game more fun.
I also tried my hardest not to copy any levels pushmo made and had a lot of help creating brand new levels.
The biggest point of all is that the game is free for anyone to play, and I hope anyone that plays my game highly considers buying a 3ds and getting pushmo for the real experience.

First, these things work under completely different rules due to their very nature. Fan art, as in 100% original work derived from an intelectual property for non-profit is generally OK. Same with Fan Films.
Sprite Work, specially the duplicated or ripped kind, is ONLY OK when the actual owner of the intellectual property permits or gives written consent. They are not acceptable by default.
Also, comparing copying sprites from 10 to 20 year old games to OUTRIGHT COPING AN ENTIRE game concept from last yeas is not exactly equivalent.
If you're reading this, I have a suggestion. Of course, you could be on other sites trying do defend yourself, so I don't blame you if you don't do this because you didn't see this comment. Take the game off of the Google Play Market, and take it to something like, I dunno, TIGsource, or make a small blog somewhere. If you're really going to try and make this into something more differentiable, that's pretty awesome, but until it is, I'd consider taking it down for the sake of not getting yourself into a legal battle. Places like TIGsource would be fine with playing something and giving feedback, so if that's what you're looking for here, I'd go elsewhere so you get a lot less attention. If you make it something different enough, hell, admit your inspirations and release it on the Market again.
You need to differentiate yourself enough to really consider it OK, and even though it's bullshit, it doesn't help that Pushmo isn't very old. If it was an older game out of it's copyright, or one Nintendo bludgeoned to death with sequels (I say that lovingly), it would be more okay, honestly.

you all say Blockshift copied Pushmo whose to say Pushmo didnt copy Cathrine on Xbox 360/PS3 that has the same block elements where you solve puzzles. Another thing the game Devil World for NES is Miayamotos first NES game and its a clone of pac man very similar the man who made mario and zelda copied stuff when he first started too.
The dev added the Vine block that adds a new element and makes it different and above he said he was adding new block type to make it even more different.

QR codes are not proprietary. Nintendo didn't invent them, using them to build levels in a game is not something anyone can own. It's like bitching about Audiosurf and Beat Hazard both using music to generate levels.

Couple of things:
Devil World isn't Miyamoto's first NES game, it's Takashi Tezuka's first game. Miyamoto's first NES game was Donkey Kong 3 and his first game is, as we all know, Donkey Kong, a 100% original idea.
And while it's hard to deny that Devil World is an obvious Pacman knock-off, calling it a "clone" is a stretch.
Similarly, implying that Pushmo copies Catherine has got to be one of the biggest leaps in logic I have seen in a while. Might as well say these games copy Solomon's Key and Adventure of Lolo.
And just adding one or two new ideas while keeping everything else, including the aesthetic, exactly the same? Sorry, no free pass.
I'll grant that the guy probably didn't mean to do anything wrong, but whether or not he did is up to the parties involved, not us.

The image formatting to transmit the data is a worlwide standard. The DATA it transmits is not, and unless Nintendo has given you an open license to use the data that these Q Codes distribute, you can't use it.
A QR Code is just a string of bytes arranged as a black and white image. The program that reads it must know what type of data it is to interpret it. The fact that the Copy Game can interpret it exactly as the original program is just evidence that it's probably ether copying the game's code or genuinely attempting to work exactly like it, and that, too, is a copyright violation.
I'm currently working with a team to develop a game that uses a very similar mechanic to another flash game which itself has a mechanic unique to that game. The game we took the idea from was a fun, but short little experience. We are taking the idea and expanding it, adding new elements and ideas of our own to flesh out the idea more than the original idea did. Are we "ripping it off"? I would argue that no, we aren't. Although the particular mechanic used in gameplay is unique to only one game thus far, the games will be completely distinct from each other. If we were ripping the levels off of the original game, then yes, that would be ripping it off. But no, we're designing a new experience-- just around the same mechanic.
What I'm trying to say is, I don't think games that use similar (even identical) mechanics are necessarily automatically "ripoffs". It's how the developer decides to implement those mechanics that will make the "inspired" game unique.
Basically, its proves all the more there is a need for licensing and authentication in these markets, even though its not a perfect system. The more so-called "indies" that steal and copypasta games, the closer we come to a licensing system that hurts the real independents. Just remember that when you download it. The gold rush of the iOS/Android market will not last forever.
Still buying Pushmo, won't be downloading this.

Lets allow all games to be copied this way... Uncharted would be pretty awesome for free on android, as would Halo. Hell, someone get me the story script from FF7 and I'll fund the remake you all have been wanting for... and give it away on the iPod.
But don't worry: I'll change the color of everyones hair and rename them so it won't be an exact copy.
Look, this isn't evil or wrong, certainly not to the extent that many here are saying. But is it something we want to actively tout as being 100% okay as well? Is it something you would appreciate if it was one of your favorite games, and the original maker was damaged as a result?
Maybe if the guy was Chinese, like in the case of the Super Mario Galaxy ripoff incident more people would be upset...^_^;

A "copyright" covers an intellectual property, including code, art and it's function.
So yeah, "gameplay" is Copy-protected.
And for all that say hosting sprites and other levels from another game is such a big deal. What about games like team fortress 2 and Counter strike and all pc games that have mods and custom maps that rip assests like sound and art directly. They are hosted but its okay right? TF2 has tons of mario themed levels. Point is everyone even greats like Miaymoto copied other games.
1) You don't seem to understand CopyRight law. That's ok, most people don't.
You CAN copyright gameplay and gameplay systems. Many companies do. The thing is they don't bother to ENFORCE those copyrights. Wolfenstein 3D was released as shareware, opening the gate to modders, making the copyright over the 1st person perspective unenforceable. This happens all the time. Copyrights are powerless unless the owner actively enforces them.
Which takes me to the next point, mods. Have you ever bothered to read a moddable game's User License? Mods are legal because the company that makes the game ALLOWS them to be made by the fanbase, because they have more to gain from the positive buzz than protecting their code.
Nintendo won't throw you a "cease and desist" over a fan created level or even game unless it tarnishes the brand. THAT'S why these things exist, because:
A) the content owner allows it, or
B) because the content owner lacks the power or drive to enforce his own copyrights.
That's it, period.
As for the whole "Miyamoto copies games": anyone trying to equate grabbing some gameplay elements from one game and making another, to OUTRIGHT DUPLICATING A GAME, is an idiot.
Copying gameplay elements? Happens all the time, and it's ok. Cloning a game? That's not what Devil World is and claiming that it is proves you never played it.
