Banned PSN troll tries to sue Sony again ... twice photo

Erik Estavillo, the troll who got banned PSN for abusing Resistance players, tried to sue, then failed miserably, is at it again. Not content with getting his ludicrous case thrown out of court, Estavillo has decided to appeal the decision, determined to make Sony pay for the mental anguish that a PSN ban allegedly inflicted on him.

Not only will Estavillo appeal the original case, he has also filed a new civil claim against Sony, demanding $108,000 compensation. This is quite a significant boost to his original claim, which "only" asked for $55,000. Estavillo claims that Sony's banning caused him "pain and suffering" and violated his rights to free speech. He also alleges that he had money invested in his PSN account, which amounts to theft on the part of Sony. 

Estavillo has opted not to use a lawyer, and will instead represent himself if there is a court in the land that will allow this circus to continue. I'm sure that's going to work out really well for him, since he is clearly a smart and sensible individual who deserves nothing but admiration from his peers.

Sony offered during the first trial to reimburse him for the money he lost on his account and he refused.
How does he honestly think he's going to win this? Also, doesn't he have some mental disorder that means he can't leave the house? Then how the heck is he going to represent himself?
End User agreement, Erik. You agreed to it. Now you are wasting your time and money trying to fight it. Also, couldn't he just create a new PSN account?

While I do find the whole "pain and suffering" claim to be ludicrous, this lawsuit does bring up something interesting. Say that I am playing Resistance, and I go a little off the handle. Maybe I insult or abuse a bunch of people, maybe one particularly whiney person (we all know the type), maybe it's really nothing at all. In any case, Sony has decided to ban me from the PSN. Hell, maybe it happens on a yet-to-be-announced PSN service, who knows.

I just bought a shiny new PSPgo. Sony is now judge, jury, and executioner in freezing all of my digital content. This guy may have been a total fuckwad, but look what could happen if someone wasn't but was just perceived that way. PSP-3000 FTW.

I hope the judge finds him guilty of wasting everyone's life and bans him from any online interactions. Sony could probably represent themselves with a brain dead monkey and win this one.

My favourite thing about these lawsuits are the mystical sums of money they pull out of their ass. $108000 is a ridiculous amount of money just because you were told you weren't allowed on Sony's PSN lawn anymore.

they may have banned him from psn but not from using his existing psn games. sony didn't shut his console off permanently so this will get thrown out of court again.

While I'm again baffled at this man's retardation, I DO think he almost has a point with the "money invested" in the service thing.

If he had previously bought a bunch of PSN games and now can't access them, that's an unholy amount of suckage.

Yes, he was enough of a douche to get him banned, but Sony should still let him transfer his paid-for property to a new account. Assuming this guy isn't even dumber than I think and that they haven't done so already.


And I can only imagine how impossibly entertaining of a trial it would be with a member of the lowest rung of society (a troll) representing himself.

Just bein' a dick. Apparently he has Agoraphobia (fear of being in a public place without help which usually leads to panic attacks) and that's why he's suing. Because he claims it's his only way to socialize.

Sucks that he's fucked in the head but he was being a dick on a private server under a term of agreement where he agreed to both be monitored and not be a dick.

Whats weird is, if I remember the original story, the guy sued in part becuase he had some fear of outdoors, or people, or something.

So, he's so scared of people, but will attempt to overcome it in court? I guess six figures will do that. Of course, its not as though this will actually get to court, so I guess this guy is still safe from actually having to meet people

Unless God himself intervenes, this is getting tossed, and the judgment against his previous claim will almost certainly be affirmed on appeal. What really gets me though is that he actually has the gall to represent himself. When a lawyer tells you a case is a bad idea, he's not just being lazy.

I'm more concerned about the idea that Sony can for any reason disable my content and is telling me that I should go digital. Obviously, if I'm about to fly off the handle, I should do something about that. What happens when someone convinces Sony that I flew of the handle? What happens when I post about a firmware modification on Dtoid, someone notifies the Happy Sony Anti-Piracy Team, they see my PSN id in the post, and they disable it. All while I only commented on it, but never actually installed it. In a world that wants us to be connected at all times, it will become increasingly easy to turn off content on systems like the PSPgo. It's a private service, and they can run it how they want (free speech doesn't apply to PSN), but the idea of having my content shut off for a poor reason just makes me scared for the future. Okay, enough rambling.

This guy doesn't have a leg to stand on. He'd spend more money on wasting the courts time, than just.... buying a new PS3 and getting a new account., thereby solving his entire problem It's unbelievable that he doesn't see this.

Well, blind rage is blind rage. He's probably so angry that he's not thinking right. As timtheterrible said, someone should, if possible, videotape the court proceedings and put it on youtube. It would be funny to see him break down in tears when describing the "pain" and "mental suffering" he has been through. I don't care if he has agoraphobia - which is a real condition by the way - because many agoraphobics can deal with their problem in other ways, like by reading books or listening to the radio or watching TV.
