Activision: West, Zampella wanted to steal Infinity Ward photo

So Activision is counter-suing Jason West and Vincent Zampella. We've told you about EA's snarky commentary on the situation, but let's get down to brass tacks. What the hell is going on here? Espionage, betrayal and backstabbing, that's what!

According to Activision's new 23-page complaint, "West and Zampella's misdeeds formed an unlawful pattern and practice of conduct that was designed to steal the [Infinity Ward] studio, which is one of Activision's most valuable assets -- at the expense of Activision and its shareholders and for their own personal financial gain."

The two men are accused of going "on a secret trip by private jet to Northern California, arranged by their Hollywood agent, to meet with the most senior executives of Activision's closest competitor." Who's in Northern California? EA is in Northern California. Makes that lack of a comment thing even a bigger slap in the face, doesn't it?

West and Zampella's lawyer has called these accusations a load of crap, but not in so many words. Actually, in many, many more words.

Damn good thing I don't give two shits about Infinity Ward!

Though, still not sure if this beats Anthony Burch and his turbo-suing of Gaijin Games...

I fucking called this the second the original story dropped. They were looking to move IW after their contract with Acti expired. Any reasonable boss would see what they're doing as reasonable preparation for their future, but not Activision.

Long story short: Activision will eventually win, West and Zampella will still be out of work, Infinity Ward will continue to work on great games under Activision, with a renewed contract put in place by more receptive parties. Interested gamers will watch the shit hit the industrial fan as names are called and dirty laundry is aired, all the while over-complicating the situation at hand with accusations, suppositions, and assumptions based on shaky third party speculation. Eventually, most will forget or forgive.

Is it pleasant? No. Just? Maybe not. Likely? Very.

everyone use to hate ea now we all hate activison... well I hope the two dudes win because to activison lose would make my day. Kotick is a douche. He doesn't even play the games he just wants the money. He wonders why he woke up on the death star his one reason and there is many more. Everyone should leave Iw and work for dice. Cause if iw is under contract with activison they can't make anything for someone else but if everyone else ups and quits makes a new studio with ea's help that would be great

EA has become one of my favorite publishers ever. Battlefield, Skate, Dead Space, Mirror's Edge, Mass Effect, Valve stuff, etc. I'm not in love with the Call of Duty series, but I can see that Infinity Ward has some skillz. EA already have a ridiculous line-up of developers as it is.

How can West and Zampella be sued for talking to another company? If your contract is up, then can't you shop yourself around?

Wait, why would they plot on stealing a company they were already running? Unless they meant to make it independent.

Another move could be the developers quit and make a new studio, but that actually is very inconvenient unless they got another publisher.

There's far too many problems with this...

West and Zampella are clearly violated their contract, so i'm sure they'll lose this case.

Does that mean I support activision? Not in the slightest. But when a company puts ALOT of funding into you, you have an obligation to fufill your contract you make with them.

Besides, it's not like West and Zampella are starving for cash.

Wow. That is a bold claim to say they were trying to secretly sell off IW to EA.

If I were to secretly sell off my developer to a rival publisher I sure as hell wouldn't use traceable funds from my current publisher.

lol, Activision is full of shit, they're making these bold claims so their counter-sue can keep the whole thing in hiatus, just keep elongating it and theres no consequences

West and Zampella shouldn't lose this case, for the time being Activision's claims have no substance, they flew to North Cali...imagine if you flew somewhere...came back and lost your job.

Well, I imagine they have a better case than they just went to North Cali. Given that those two guys did such a thing, it very well could have voided their contract and given Activision legal rights to get rid of them.

Granted, if their aim was to keep these guys and IW from running to EA or going independent, umm, welL:

The way i see it West and Zampella were merely preparing to ditch Activision once the contract was over, Kotick saw this an threw the whole legal BS and got'em fired, my basis of this is the news of key people leaving IW after this whole fiasco which is very telling IMO, granted so far few, but if Activision wins you can bet more will come, also, who the fuck will want to work with/under Activision if they win this thing?.

With a bunch of Infinity Ward developers leaving Activision as of late I wonder if they'll be migrating to EA to form a new studio. That would be great news in my mind. EA let's their studios do some really creatively interesting things between Visceral and DICE. Another studio like that would be really great.
