Activision did not allow retailers to break street date photo

A number of you reading this already have Modern Warfare 2, despite the game not being released until November 10. A number of retailers across North America started selling the game a few days ago, and have been claiming that Activision gave them permission. The evil publisher has today released a statement saying this is not the case.

"Activision has not given any retailer permission to sell Modern Warfare 2 prior to the Nov. 10 street date," states the publisher. "The company fully supports the Nov.10 street date."

Further to this, Infinity Ward's Robert Bowling has Tweeted on the subject, stating that there are no "special permissions" and that any retailer selling the game is violating street date. However, he added that anybody lucky enough to find the game ahead of launch will not be punished if caught playing it.

It would be odd for Activision to give out special permissions, especially since not even your humble reviewer has been given the gift of pre-launch review code. Still, that might be due to the fact I gave World at War a 6.0 last year.

I just preordered my copy today. It was an awful, awful experience. The Store Manager told someone on the phone that they can play the campaign but not the multiplayer, otherwise they'd be banned. I asked if that was true, and they said it absolutely was, which I argued with, at which point they told me, "That's what Activision said, and they made the game." After arguing about their "trade 2 games in, get MW2 for 20 dollars" promotion for another 10 minutes, I also found out that they were giving away copies of the game to people who had preordered it "before today"! They told me to come back on Monday, but that I probably won't get one until the next shipment.

GAMESTOP IS THE BEST.

Some kid tried to trade in 2 games that were on the list for the MW2 offer, and the manager said no. I was standing by, whipped out the list from my pocket, and owned the manager. He was trying to scam a kid!

@Magnalon I kept the list in my pocket, too. The Assistant Manager first told me that I couldn't reserve the game using this promotion and to come back on Tuesday, then he told me that my games weren't on the list (COD4 and LBP), then he told me that he'll check but it probably won't work, and then he just relented. These fucking people, man.

After listening to Sheir's story it makes me glad I pre-ordered online instead of a store. For circumstances like he talked about are the reasons gamers don't go into the store. We don't want to deal with that kinda crap just to order or buy a game.

I, for one, will be glad when everyone has their copy of Modern Warfare 2 and can expend all their time playing it...and not typing about it :)

Me? I want more info on the Borderlands DLC that Gearbox needs to be hyping to hell and back.

I work at a GameStop, and combined from Saturday and Today, I got about 25-30 people asking if we were releasing it early. It was so annoying I changed my phone greeting to "Thanks for calling GameStop, Modern Warfare is available tomorrow at midnight....." Not surprisingly, a lot of people hung up after that

This is where living in Hong Kong has its perks!
There are no release dates issued for games here, so as soon as a new title arrives in stores, they can sell it! I've had Modern Warfare 2 since Friday, and we got Uncharted 2 a whole week early.
Plus MW only cost the equivalent of £32, which compared to the UK is a freaking bargain!

Some local stores in some locations broke street date. Gamestops located next to these areas get undercut because people cancel pre-orders and buy it from who ever broke street date. Because GS gets screwed out of business because of local competitors, GS stores in those areas break street date as well. I don't think Activision or Gamestop are going to admit to anything. But whether people are given permission or not, doesn't meant that they can't just pay the fine, move on and reap the rewards from early sales.

It doesn't hurt my feelings any.

UPDATE: Activision DID allow select Gamestop stores to break street date where mom and pop stores were already breaking street date to protect their sales. Via Kotaku.

I think it was just honest ignorance/confusion, if you had any problems picking it up today. I for my part found out that yesterday (Saturday) my local EB Games was selling it, then today they were only letting previous preorders (but not people preordering today) pick theirs up; I wouldn't be surprised if some employees didn't get the messages one way or another.

@CountChocuIitis: Not true, it doesnt say Activision allowed Gamestop. All it says is that Gamestop Corporate decided to break the release date after some talks with Activision. It was Gamestops decision, not Activision.

It's interesting so see how Activision is gonna react to this, will it fight the largest retailer with boycots or fines or will they allow it like a dog with its tail between its legs? Would be nice if anyone could dig up the contract that came with the games' release date that stores had to sign!

my store has been getting 65,000 calls a day about this shit.

i dont even understand why games are street dated. if they're finished and have been sent to my store, i should be able to sell them, not leave them hanging around to collect dust. jesus fuck.

I was surprised to find out a few Amazon preorders around my block arrived as soon as last Friday. One guy who got his on Friday said he never even received an email that it was shipped out so clearly that was a big time fuck up on their part.

But does any publisher ever clear anyone to break street date? Seriously?

Well if they wanted to stop the foolishness of people breaking street date they wouldn't send copies to stores early.They would expedite ship them to the store the morning of the release or in the case of a midnight release have them there in the evening. A nice bonus to this would be that stores would be much safer. A Gamestop in my district actually had to close early because they felt they were in danger from a kid who was stalking and harassing the employees and customers because he knew we already had received shipments.

I hear ya.

Any game that is street dated, which are most big games anyway, get shipped a week or so early. Band Hero for example arrived in stores the Friday before the week its released. MW2 arrived in stores the early part of last week as well. So with that said, can Activision really expect people to honor the date? Local vendors make more profit to just pay a large fine and continue to sell the game then to wait until the date and try to compete with companies that have over a million preorders throughout. Thats why its only big games you ever hear about. You think publishers would stop shipping their products to these stores, but you still hear stories of SDs being broken, so obviously these big publishers must not see it as a HUGE problem like they make it out to be. I doubt that GS or Activision really truely cares about whats happening.
