360 failure whistleblower fired by Microsoft photo

Last week, VentureBeat's Dean Takahashi (author of The Xbox 360 Uncloaked: The Real Story Behind Microsoft’s Next-Generation Video Game Console) posted an in-depth look at the hardware problems that have plagued the Xbox 360 since the time of its launch. Today, the one named source inside Microsoft for the article, a contract game tester named Robert Delaware, was fired for his participation. In addition to losing his job, it also appears that Mr. Delaware may be facing civil charges from both Microsoft and Excell Data (the temp employment company who arranged his contract).

In the original article (a very long but excellent read), Delaware suggests that Microsoft's failure to divulge information to the testers working to identify bugs likely resulted in the prolonged existence of many of the hardware errors present in the console. He specifically names a bug present in NBA 2k6 which caused consistent hardware failure and even the Red Ring of Death, as well as issues resulting from the practice of including dashboard updates on retail discs.

Delaware has no regrets about the situation, calling his contribution to the article, "the moral thing to do.”

It should be pointed out that Microsoft is completely in their rights to terminate the employment of someone who discusses sensitive corporate information with the press in such a manner, as well as seek legal action against them. That said, I find it comforting that Mr. Delaware had the courage to speak out on this issue. Companies need to be held accountable for their actions when consumers are suffering from poorly designed products and being willing to put your career on the line to ensure that is worth a lot of respect in my book.

My best wishes go out to Mr. Delaware. Thank you for standing up.

But couldn't he have stood up and done so anonymously? Still, it was very noble of him.

@Yojimbo: They sure are, just like every corporation who places a priority on profits. You know, every corporation.

If this had been Sony the same thing would have happened except that as well as getting fired the man would have had to kill himself because he soiled his and his companies honor.

Releasing the info may or may not have been "the moral thing to do.” but putting your name on the leaked info is certainly "the dunderfuck thing to do."

MS is evil, they should have given the guy a raise and a promotion.

Sarcasm aside, I'm sure employees have to sign some kind of non-disclosure agreement and this guy broke it though I'm sure the usual crop of idiots will paint MS as some sort of devil and the guy that was fired like a hero.

I hate Microsoft for what they did to the hardware of the 360... I really like Microsoft O.S. no complaints about that. But the mess the 360 hardware is... man, they should recall that broken thing off the market.

I suffered incredibly from not having a working 360 for a week one time due to RROD. So heroic.

Couldn't this fall under one of the laws that protects whistleblowers? I'm hoping he finds a way to make it fit, he deserves props for doing what MS should've done.

I hope he goes to a pound me in the ass prison (and fined) for breaking what is probably and iron clad NDA littered with lots of legal recourse. He also probably screwed his temp agency out of a lucrative contract.

He's no hero, he's just another employee that wanted 15 minutes of fame for "whistleblowing" on something that we pretty much already knew!

Frankly, as anyone that's worked in a tech firm knows...Most everything described in the article is fairly commonplace for new software/hardware releases. You know how many bugs the product I work on shipped with last month? Over 1,000 known issues, with 30-40% being showstopper/high priority issues. You fix things when they break in the field.

It's fascinating that people are condemning this guy and defending Microsoft. MICROSOFT! What the hell are you thinking? Just because one company does shoddy work means that it's okay for everyone to suck at their job?

I think it's great that at least someone is giving the finger to money grubbing worms.

Syn: It's one of those rare cases why MS didn't do anything wrong. The guy probably signed a non-disclosure agreement and was fired after he broke it.

@Chibi_zero: your right, Firing the guy for breaking the NDA is not wrong, the only thing MS did wrong was the 360.

If this guy valued his job, he wouldn't have gone on record using his real name.

My original Xbox died an early death due to a faulty Thompson DVD drive, so I absolutely refuse to buy any 360 hardware until their quality control issues improve.

I want another system price drop as well, and given that I don't own an HDTV yet, I can wait another year or two if necessary.

Techincally, and this only according to US law, you aren't allowed to fire whistleblowers. I'm sure the big M$ found a way around it, but if he blew the whistle correctly, he's supposed to still have his job.

Why is everyone on this guy's side? He more than likely broke a contract. He should have known this would happen, so there should be no pity for this man.

Business is business, guys. Welcome to the real world.

@Chibi_Zero: I'm not saying the guy shouldn't have been fired, he totally earned every bit of M$ coming down on his ass. But I don't think Microsoft deserves all the backing that people are supplying

Yup I'm under a contract to not talk about anything my company is doing, nothing wrong with that right? That means if I find out the company is doing something shady, like insider trading, manufacturing faulty hardware, I can't say shit. Bullshit if you ask me, I'm glad this guy spoke up, at least he had the balls to do so when he probably knew it would have ramifications. Some will call it stupid instead of ballsy but you'd be surprised how much those 2 things are similar.

I guess there might have been a secrecy clause in his contract. Otherwise...
