$50,000 scratched disc lawsuit moves forward photo

Jason Johnson claims to have had his discs scratched by his 360 and he wants revenge, damn it! This past December he sued Microsoft over the issue for $50,000, claiming that Microsoft had knowingly sold a faulty system. The original complaint had been thrown out, but Johnson was allowed to amend the complaint and return. He did so this past August. He is seeking damages from Microsoft's "alleged violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, negligence, breach of implied warranty and strict product liability." Madison County Circuit Judge Daniel Stack is presiding over the case and dismissed two of the counts against Microsoft, but has allowed another two to move forward. 

Microsoft had moved to throw the second, amended case out entirely based on the claim that Johnson had not bought his own 360, but instead had it given to him by his wife. That don't fly in the house of Judge Stack, though. It seems he agreed with Johnson's lawyer that the Illinois law did give Johnson a standing to sue. Microsoft has 21 days from September 2 to respond.

Now that this has moved forward who wants to put money down on the issue being settled out of court? Maybe Johnson is a crusader, though. He could be fighting to make a point. Whose side are you on? Is Johnson just a money grubbing jerk or should Microsoft pay for the eternally malfunctioning Xbox 360?

hard to say- i think that MS deserves some lumps for putting out shitty hardware, but the guy has no reason to sue for 50k- I would be a little more apt to side with the plaintiff on this if it was a class action

I'm somewhat on his side. Being one of the most wealthy companies in the world, it's not like they don't deserve a bigger slap on the wrist for selling a product that made them millions and had an overwhelmingly high malfunction rate.

Yes Microsoft made a faulty console. But 50,000 bucks? That's nonsense. Did he try to just get his money back? Demanding 50K puts you on the same end as Microsoft. I think I'm gonna sue him for being a greedy asshole.

Money grub........he probably moved his 360 or placed it on its side while a disc was playing in it, that causes some pretty nasty scratches on discs, just ask for a new console and/or game.....Its happened to me. Outside of the RROD, shit happens.....this douche just got extra pissed and thinks he's got a case.

Its pricks like this, and pirating that cause the retail game and console prices to go up because of the money spent in court.....of course its probably just a drop in the bucket for MS and mr. gates, but added up over time, its alotta dough......It's kinda like the guy who breaks into my house, I shoot him and he sues me for a gunshot wound (take that for what you will).......WTF?

Theres a reason the judge has thrown it out twice already.....the guy does'nt have much of a case.....sorry dude, get a job, stop trying to rip off people.......I'd be willing to bet he's tried to sue people before and has a history of this kinda action........My verdict: DOUCHE-BAG

I'm not gonna argue the guy's somewhat ridiculous. Only reason I can slightly understand his $50k is that it's gonna cost a hell of a lot to fund a case against MS as well as the time lost(and actually from a legal standpoint, you're allowed, and actually expected to request compensation for any stress of emotional trauma attached to your case)

There's 2 sides to every story, and the court will hear them both. (also, if he loses, then all those people hating on him will be happy to know he wasted what he deemed as $50k worth of his life in the process.)

The perpetrator cannot sue in states like Florida, where it's legal to defend your property with lethal force. It depends on state law: some states have deemed lethal force like firearms unnecessary, due to the overwhelming amount of deaths due to firearms each year from people shooting at kids/young adults who are screwing around.

It's true really. According to GameInformer's recent poll, 54.2% of 360 users reported a hardware failure, 41.2% reported a 2nd hardware failure, and 36.4% bought more than 1 360 due to the hardware failure rate.

That basically more than double's their console sales for 36.4% of their initial install base. Which would lead them to, justifiably, believe those are some really happy customers.

Reminds of that movie, Desperado, where Quintin Taratino says that joke about peeing in a guy's face and not only is the guy happy about it, but he'll pay him for it. (no offense to anyone directly or indirectly)

If I don't play my 360 for more than two days, I turn it on and it sounds like it's grinding my discs. It has nothing to do with "touching" it or moving it.

It's a clingy fucking thing, and I hope Microsoft takes it up the ass for this shit. They didn't put in those little pad things that every other company has put in that stops this kind of stuff from happening.

This lawsuit is completely legitimate as far as I'm concerned. I love my 360, and fortunately it has yet to scratch a disc of mine to the point where it's unusable, but it's a terrible piece of hardware, and every time Microsoft gets punched in the face for it I believe they'll remember when they make the Xbox 720.

how about we tell that kid to STFU and just get another disc but MS has to fix their 5 year old faulty console to actually work with no problems and replace everyone who has bought the shitty version with a fixed version?

That would be the correct thing to do from both ends. But since we live in the real world were people and companies are greedy alike, cases like this will happen and the morality name of this case should be:

This guy is OK in my book. While I know it's true you shouldn't move the 360 while a disc is playing, that doesn't mean the console doesn't scratch games when sitting perfectly still. My CoD:WaW is destroyed, although it actually works. It's got 3 round scratches, and I've never moved the damn thing while playing, not once.

I would say the guy is in the wrong if MS replaced all his discs, but they don't always do that. They charge 20 bucks from what I remember.

So fuck them.

MS deserves to be sued for this. But at the same time, I think a lot of people exaggerate the issue. M$ has handled it very well, and they aren't asking more money of people that get the RRoD/e74 errors. I actually know a guy who thought his 360 ran really loud...so he used the towel method to make it overheat and RRoD, then got a refurb'd 360 for free by calling in. It's not like they're going to continue to make cheap hardware because people still buy it. Obviously, it's not as profitable for them to have to fix "54%" (god I'm sick of this statistic) of the 360s on the market.

Now, about the case itself. I hope this Johnson guy is trying to make a point, because if he's not, he's an idiot. But either way, M$ feels it. Pretty much a giant middle finger to their hardware failures. =)

This should have been a class-action thing given the failure rate of 360s. At this point there is no way in hell MS wasn't keenly aware of hardware issues and still manufactured the consoles anyway.

you know airlines and car companies have been releasing defective products and breaking rules on that front for decades and they still get away with it. So to hope MS is going to 'learn' anything is hoping for a bit too much. It's cheaper to settle all the court cases our of court than it is to make and deliver a better product.

In fact if anything this generation has taught them that they can get away with it, 'cos for all of our bitching, most of us just go buy another one if we get the RROD.

Profitwise MS is blowing Sony out of the water, I wonder how much of that is down to corners cut on hardware manufacturing. After all we already know they sort of stole some of the research.

Should we care if he is an ass? i say that makes it even better for us: if the guy is a money grubbing jerk and wins it will settle precedents for legitimate users cheated by MS's crappy manufacture and tactics to sue, oh i can just orgasm over the though of a massive class action lawsuit. If he settles out of court, well, f*ck it, we didn't win or lose anything. If he loses no big loss since he was an asshole anyway. Personally i hope he wins and forces MS to go through the utter wallet rape it deserves for it's trickery.

If he settles out of court, he is a cunt. If he continues the suit and succeeds, therefore paving the way for thousands if not millions of similar claims then it is a different story entirely. I've lost 4-5 discs to this, and I think that refunding the cost of the console and replacing the games is the minimum that their customers should expect, but asking for $50,000 is retarded.

As for the wider issue of them knowingly selling faulty consoles, assuming the suit is successful the court ordering a charity donation of about a billion dollars ought to discourage Microsoft from doing it again, and seems completely fair considering their core business model of repeatedly fucking consumers in the arse.

About time some judge takes Microsoft's neglect into account for the 360 but $50K? This guy is out for everything he can get and I actually hope he wins so no game company will ever release a system that has so many problems again! oh and my DS broke awhile back when the top screen cracked. I mention this because it cracked when I tripped over my wife's Wii balance board! Wonder if I can sue Nintendo?

Sigh. If this guy were serious, he probably would have tried to build a class action suit. One guy suing for $50k should probably take the first settlement the offer. Otherwise, Microsoft with pay their lawyers FAR more than $50k to not lose this one in court. All they have to do is keep things in the system until joe average here runs out of money. Because no lawyer is doing this pro-bono, and he wouldn't be suing microsoft if he were rich enough to afford to. Just another greedy jerk. If he would've went through MS's customer relations, they probably would've replaced everything for free. Its cheaper for them to do that then play hardball. What probably happened is that the dickhead threatened to sue while on the line with customer relations, at which point they're likely not allowed to deal with you. I know that's how it is with my job. I can move mountains for you, until you threaten to sue. Then I have to pass you to the legal department and it's out of my hands. This guy is either stupid or stubborn, and neither one of those scenarios is going to end well for him.

You'd have to check the Illinois code for consumer goods for the validity of this case. But Microsoft knew there were problems with their console and they still released it. Maybe it was due to quality control problems but who knows? Those laws are there to protect consumers from companies who screw them over in this case it's Microsoft. If it had been a problem with the console lighting on fire they would have done a recall (like they did with the first xbox). But just wasting people's money and time doesn't seem to be a factor in their companies quality assurance division. Despite the consoles strengths The consumer quality assurance service shouldn't have let it come to market with the failure rate it had. Imagine if another consumer electronic had a 50% failure rate? I think we only put up with this is because half of us are addicted to gaming :S. At least the problems seem to be clearing up now with the Jasper chipset (so far that is).

Not a big fan of Microsoft for that very reason. If they would put out a system that "works" I would probably own a 360. I think that Microsoft won't learn it's lesson until they have to pay someone something. Here's hoping the 720 works beautifully in 2013! lol

As for the gut suing, he doesn't deserve $50,000 for being whiney. The 360 breaks a lot and is faulty to a point but Microsoft has spent a shit ton of cash to replace your red-ringed xbox. It's not a perfect console nor is it a perfect system set up to replace it but its what we have. Suing them for disk scratches won't change anything they've done/will do. Frivolous law suits are a great example of why we fail as a species.

Microsoft should have sorted this issue out as soon as it reared its head, issued a swift recall, fixed the problem and wiped their own arse nice and quickly. They dropped the ball and played down the scale of the problem and it's done them a significant amount of PR damage so that they are clinging on by their fingernails to the number two position of worldwide console sales.

The judge has to be taking some delicious drugs to think that $50k is a fair settlement to one consumer for a faulty console and a scratched disc, but as long as things get played out in courts the longer MS will be given negative coverage and the more likely they will settle quickly and get the story out of the news.

If I were the head of 360 development and saw PS3 sales catching up in the rear mirror, I'd promise a lifetime guarantee against red rings, 800 MS points to anyone who has to ship their 360 for repair and issue free Gold membership, with a generous MS points reimbursement to those currently paying. It would make silly problems like this go away.
